S 13-01-14, for bills which are not paid <br />within 90 days; and 2) the contractor will file a payroll report with <br />workforce safety and insurance and pay all required premiums. <br />ND.C.C. SS 48-02-06.2,65-04-10. <br /> <br />All construction contracts, except those involving federal aid or <br />where a preference would be contrary to law, must include a <br />clause requiring the contractor to give preference to North Dakota <br />residents in hiring, with preference given first to veterans. <br />ND.C.C. S 43-07-20. Any state agency or contractor making <br />repairs or alterations or constructing state buildings must purchase <br />materials made or produced within the state, price and quality <br />being equal or better. ND.C.C. S 48-02-10. <br /> <br />With some exceptions, any retention of amounts due to a <br />contractor under a public improvement contract is limited to 10% <br />of each estimate presented until the project is 50% complete. <br />ND.C.C. SS 43-07-23, 48-02-07. <br /> <br />Goods purchased by OMS on behalf of state agencies under <br />N.D.C.C. ch. 54-44.4, or pursuant to purchasing authority <br />delegated by OMS, are usually purchased under a competitive <br />procurement procedure. OMS deveiops specifications, receives <br />bids, and may reject any bids or negotiate for a lower price with <br />the successful bidder. Term contracts and multiple awards for <br />certain contracts are also authorized. ND.C.C. S 54-44.4-05. Examples of <br />these contracts include: <br /> <br />1. Contracts for construction of pubiic improvements if the <br />estimated cost exceeds $100,000. ND.C.C. S 48-01.1-03. <br />2. Concessions in public buildings or on public grounds. <br />ND.C.C. S 48-09-01. <br />3. Highway construction contracts exceeding $20,000. <br />ND.C.C. S 24-02-17. <br />4. State printing contracts.
