4. INSURANCE AND INDEMNIFICATION A. INDEMNIFICATION: The Lessee agrees to indemnify and hold Lessor, and the City of Fargo harmless from and against any and all claims, demands or causes of action arising (1) as a result of utilization of the leased premises by the Lessee, or (2) during the term of this lease; provided that Lessee's duty to indemnify and hold the Lessor harmless shall not apply if the claim, demand or cause of action results from the sole negligence of the Lessor, Lessee's obligation to indemnify and hold Lessor harmless shall include all costs, legal fees, or expenses which Lessor may incur in providing a legal defense to such claims or causes of action Lessee agrees to pay for any and all damages to the Fargo Civic if such loss or damage is the result of the Event. B. INSURANCE: Lessee shall provide at its own cost and expense, a Comprehensive Public Liability and Property Damage Insurance policy, A Certificate of Insurance shall be provided to the Lessor a minimum of seven (7) working days from the starting date of this Event. The insurance must be written by an insurance company licensed to do business in the State of North Dakota and have an A.M, Best rating of A+ or higher. If the Lessee fails to provide the aforementioned evidence of insurance by the started date, the Lessor shall have the right to either obtain the required insurance with the premium to be paid by the Lessee or to cancel the Event. Lessee shall name the Lessor, the City of Fargo, the Fargo Civic Auditorium Director as additional insured. (i) Such insurance shall be provided by a comprehensive general liability insurance form of policy including the broad form liability extended coverages, with a combined single limit of at least $500,000 for each occurrence, (ii) Lessee shall also provide necessary Workers Compensation insurance for Lessee's employees, 5 05/03/96
