In the event of such default, the Lessor may take possession of any and all of said property and exercise any remedies provided by law, This remedy is not exclusive and the Lessor may, at its discretion, pursue any appropriate remedy to recover any or all deficits remaining of the rentals and expenses due the Lessor. 3. FOOD. BEVERAGES, NOVELTIES AND DECORATING A. CONCESSIONS: The Lessor reserves the right to all concession sales, including but not necessarily limited to all food beverage products vending items, souvenirs, novelties, etc. Permission to sell any merchandise must be granted in writing by the Auditorium Director, The Lessor will be entitled 20% of gross sales plus a selling fee if merchandise is sold by Fargo Civic employees, The Lessor is responsible for execution of the payment. B. FREE SAMPLES: Neither the Lessee nor any of the Lessee's exhibitors, patrons or guests may sell or give away any samples offood, beverages or any product deemed in competition with item sold or distributed by the Lessor without prior written approval of the Lessor. C. INTERMISSION: lfthe Event covered under this agreement lasts more than one hour, Lessee must provide a minimum of one intermission of at least 15 minutes, D. ALCOHOLIC BEVERAGES: Sales and/or service of alcoholic beverages in the Fargo Civic is allowed only by a caterer who has submitted proof of proper licensing and insurance and has signed a catering contract with the Fargo Civic. UTILITY SERVICE: Gas, electrical, water telecommunication and other equipment and services needed by the Lessee, the Lessee's exhibitors or guests must be ordered through the Lessor, Services or equipment exceeding the facility's installed capacity shall be contracted through the Lessor and installed in accordance with all applicable laws and codes, 4 05/03/96
