Mr. Steiner said it is a similar system to what was <br />recently installed in the Cass County Register of Deeds Office. <br /> <br />Birch Burdick, State's Attorney, reviewed all of the contracts with Mr. Steiner and approved them <br />as to form. His only comment was whether the Commission should consider asking for <br />competitive bids, although it is not required by statute, but he also recognizes this may be a <br />unique product. <br />MOTION, passed <br />Mr. Koenig moved and Mr. Wieland seconded to authorize the Cass <br />County Commission Chair to sign the Eagle Computer Systems, Inc. <br />sales agreement. On roll call vote, motion carried unanimously. <br /> <br />15. ROAD DEPARTMENT, Resolution declaring public necessity to take land delayed <br />Keith Berndt, County Engineer, provided additional information and photographs on a section <br />of County Highway 14 south of Horace, adjacent to the Sheyenne River, which has been <br />damaged by a riverbank slide. He feels it is necessary to move the road further from the river <br />which will require an additional 5.172 acres of land. The land was appraised at $1,180, and he <br />provided a copy of the appraisal; however, the landowner indicated in previous telephone <br />conversations that the land was similar to other properties in the area that sold for $8,000- <br />10,000 per acre. Mr. Berndt said he was unable to reach Mr. Mickeal Fosse, the landowner, to <br />inform him of the proposed resolution declaring public necessity to take land, which is on the <br />Commission agenda for today. <br /> <br />Since Mr. Berndt was unsuccessful in his efforts to contact Mr. Fosse to give him an opportunity <br />to be present today, Commissioners asked about delaying this item. Mr. Berndt said no bids <br />were received at last week's bid opening so there is no contract to do the work, however, he is <br />under some pressure to get it done because of a deadline set by FEMA. He has requested an <br />extension of that deadline but has not received a response at this time. He is considering <br />purchasing the materials from a contractor and doing the dirt work with county forces. <br />MOTION, passed <br />Mr. Koenig moved and Mr. Meyer seconded to delay a decision until <br />the September 20th Commission meeting on the resolution declaring <br />necessity to take land for County Highway 14 slide repair. <br />Discussion: Mr. Berndtsaid a two-week delay is acceptable, however, <br />he would like to do the work yet this fall. On roll call vote, motion <br />carried unanimously. <br /> <br />16. JAIL SITE, Purchase of additional three acres to eliminate public street behind the facility <br />In a letter to Commissioners dated September 1, 1999, Michael Montplaisir, County Auditor, <br />indicated the county received a favorable offer to purchase additional land east of the proposed <br />Cass County correctional facility from Prime Properties, the current owner. This tract, consisting <br />of 3.02 acres, was omitted from the original purchase in an effort to control costs and was not <br />viewed as absolutely necessary for the jail site. However, the property is being offered for sale <br />at the purchase price of $70,000, which is quite favorable. This item was added to the agenda <br />today because the closing deadline is September 18, 1999. <br /> <br />Mr. Montplaisir said this land would provide a natural buffer and eliminate the possibility of a <br />public street behind the jail, making the area more secure.
