FLOOD BUY-OUT, Hagemeister's reauest for reimbursement reiected <br />Commissioners received a letter from Irv Rustad dated July 28, 1999, enclosing his <br />correspondence to Lonnie Hoffer, North Dakota Division of Emergency Management. In his <br />letter, Mr. Rustad states that the county cannot use program income from flood buy-outs to pay <br />the reimbursement request of Mr. and Mrs. Garland Hagemeister for expenses they incurred <br />in the amount of $2,817.64 during the time they owned the former Pat and Di Scherling home. <br /> <br />The Hagemeister's purchased the property "as is" by submitting the highest bid last August and <br />have since indicated they were unable to obtain permission to move the home by the people <br />who purportedly own the road leading out of the subdivision. The County Commission refunded <br />the selling price of $21,000 to the Hagemeister's at the July 19, 1999, meeting with the intention <br />of re-advertising the property for sale as salvage. Mrs. Quick said that Mr. Rustad intends to <br />open bids for salvage on this property at the end of August. <br /> <br />Mr. Wieland said he cannot support spending county money as reimbursement for expenses <br />which the county did not ask the Hagemeister's to incur. Any problems that were encountered <br />were not the county's fault, nor was the Commission obligated to return the bid price of $21,000. <br /> <br />Mr. Meyer said he understands the Hagemeister's have been notified this is not an allowable <br />expenditure from program funds, and they apparently asked about removing some items from <br />the home that would be somewhat equal in value to the reimbursement they are requesting. <br />The Board is opposed to anything being removed from the home. <br /> <br />Mr. Koenig favored reimbursing at least a portion of the expenses from the county budget. He <br />felt the county should have been more careful about offering the property for sale "as is." <br /> <br />Mrs. Hagemeister was present and said she has documentation saying they could not use the <br />road in the subdivision to move the home out, and she said she has pictures of the road blocks. <br />She thought the county had provided some assistance in Heritage Hills and should have offered <br />help in this situation. Mr. Hagemeister was present at this time and said it was his <br />understanding that the county cut down some trees in the path of the homes being moved out <br />of Heritage Hills. Keith Berndt, County Engineer, said the township may have helped cut down <br />some trees or it may have been done with Federal funds, but not with county dollars. <br /> <br />Wade Webb, Assistant State's Attorney, was present representing Birch Burdick, and he said <br />it is Mr. Burdick's position that it is within the Board's discretion but there is no legal requirement <br />for the county to reimburse the Hagemeister's for expenses they incurred in owning this home. <br />MOTION, passed <br />Mrs. Schneider moved and Mr. Wieland seconded to deny the request <br />of Mr. and Mrs. Garland Hagemeister for reimbursement of expenses <br />on the former Scherling property. On roll call vote, motion carried <br />with four members voting "Aye" and Mr. Koenig opposing. <br />
