<br />Commission Minutes--April 5, 1999 1960 <br /> <br />Harry Johnson, Fargo, said a new jail is needed and the sales tax option is the best way to fund <br />it. As far as a preferred site, he viewed the property near the intersection of 34th Street and 4th <br />Avenue South, and he believes that location is very adequate for a new facility. <br /> <br />Mrs. Quick invited any additional comments from the audience on the proposed jail site and <br />hearing none, the discussion was closed. <br /> <br />11. FLOOD UPDATE, Report from Lake Agassiz Regional Council <br />Irv Rustad, Lake Agassiz Regional Council, provided a hand-out listing 13 homes sold on bids <br />and totaling $107,000 from the flood buy-out program. <br /> <br />Mr. Rustad also submitted a request for a buy-out contract amendment between Cass County <br />and the Lake Agassiz Regional Development Corporation for an additional $20,250. He said <br />he would need a resolution drafted, and the Commission placed the item on the next agenda. <br /> <br />12. DEED TRANSACTION DELAYED, Road right-of-way along Highway 81 <br />The board deferred action at the March 1, 1999, meeting on a request by County Engineer, <br />Keith Berndt, to deed approximately three acres of Highway 81 right-of-way in the SE 1/4 of <br />Section 15, Reed Township, back to the adjacent landowner because the property is no longer <br />used as right-of-way. <br />MOTION, failed <br />Mr. Meyer moved and Mr. Wieland seconded to approve the sale of 3.3 <br />acres in the SE 1/4 of Section 15, Township 140 North, Range 49 West, <br />no longer used as highway right-of-way and as described on the Quit <br />Claim Deed provided by Mr. Berndt, for the amount of $1 ,000 offered <br />by the adjacent landowner. Discussion: Mr. Koenig said he talked <br />with Mr. Berndt about a selling price of $100 to get the land back on <br />the tax rolls. Mrs. Quick agreed with Mr. Koenig that the selling price <br />should be closer to the purchase price of $296 when the county first <br />acquired the land. <br />AMENDED MOTION, failed <br />Mr. Wieland moved and Mr. Meyer seconded to amend the motion to <br />sell the property for $300 per acre. Discussion: Mr. Wieland said land <br />values have increased far more than three times since the land was <br />purchased in 1936, and the adjacent landowner has offered to pay up <br />to $1,000 for the parcel. At the call for the question, the amended <br />motion failed on a 2-2 vote with Mr. Koenig and Mrs. Quick opposing. <br />At the call for the question, the original motion failed on a 2-2 vote <br />with Mr. Koenig and Mrs. Quick opposing. <br /> <br />MOTION, failed for lack of a second <br />Mr. Koenig moved to sell the above parcel to the adjacent landowner <br />for the amount of $300, which is what the county paid for it. Motion <br />failed for lack of a second. <br /> <br />Mr. Wieland said the county is entitled to a small amount of return on the property. He <br />suggested asking for written bids on the abandoned right-of-way to see if there is any other <br />interest in this parcel. <br />
