<br />Commission Minutes-February 21, 2006 3035 <br /> <br />North Dakota Department of Transportation-traffic safety grant for increased <br />occupant protection and other traffic safety enforcement; <br />Beaver Creek Archaeology, Inc.-provide written and descriptive data on County <br />Highway 7 bridge project over the Maple River; <br />Butler Machinery Company-Equipment Rental Terms and Agreement for five new <br />motor graders at a rental rate of $2,007.82 per month for each machine, and the <br />Governmental Lease Purchase Assignment for the transfer of five existing motor <br />graders. <br /> <br />6. ROAD DEPARTMENT, Storm water pollution prevention planlannual public meetinQ <br />Mike Zimney, County Planner, provided copies of the 2005 Permit Year Annual Report of <br />the Cass County Storm Water Pollution Prevention Plan. He said the county commission is <br />required to hold a public input meeting annually, in addition to submitting this report. A <br />notice was published in the official county newspaper indicating this is the time and date for <br />public input on the program. Mr. Zimney said he did not receive any public comments on <br />the plan prior to today's meeting. <br /> <br />Mr. Pawluk talked about erosion and sedimentation controls, and enforcement of the plan <br />on land located in the county's jurisdiction. Bonnie Johnson, County Coordinator, said she <br />and Mr. Zimney visited with Fargo city officials about unified regulations for both entities. <br />Enforcement will be through the county's subdivision ordinance. <br /> <br />Mr. Vanyo asked what changes have been made to the plan since last year, and Mr. Zimney <br />said the biggest change is in the proposed new subdivision regulations, which require all <br />major subdivisions to submit an erosion and sedimentation plan developed according to the <br />North Dakota Department of Transportation guidelines. He said any projects involving <br />agricultural activities are exempt through the Environmental Protection Agency and the <br />State Health Department. <br /> <br />Mr. Bennett invited comments from the public. No one addressed the board at this time. <br />MOTION, passed <br />Mr. Vanyo moved and Mrs. Sorum seconded to receive the annual report <br />on Cass County's Storm Water Pollution Prevention Plan. On roll call <br />vote, the motion carried unanimously. <br /> <br />7. ROAD DEPARTMENT, Grant application for propertv acquisition in HiQhland Park <br />Mr. Zimney said the county commission approved a request to sponsor a grant application <br />for 2005 to acquire a private residence in the Highland Park Subdivision north of Fargo. <br />The foundation of the house has been damaged due to a riverbank slide, and further <br />damage is likely. The grant was approved by the state; however, funds were unavailable at <br />that time. Both the state and the homeowner, Lars Moller, have requested the county to <br />reapply in 2006 for 75% of the cost of an acquisition through the Pre-Disaster Mitigation <br />Program. <br /> <br />If the commission decides to sponsor the grant application, Mr. Zimney said he would <br />recommend that an agreement be drafted whereby the property owner or other private <br />parties would fund the 25% local match, estimated at $103,750; and that an agreement be <br />made with the Highland Park Association for future maintenance of the lots after acquisition. <br />
