<br />Commission Minutes-July 20, 1998 1841 <br /> <br />WHEREAS, The Board of County Commissioners has been unable to purchase the land <br />required at a price which the Board deems reasonable; and <br /> <br />WHEREAS, Section 24-05-09 and 24-05-10 of the North Dakota Century Code authorize <br />the board of Commissioners to purchase, acquire, take over, or condemn <br />under the right and power of eminent domain, for such county, any and all <br />lands which it deems necessary for improving any highway. <br /> <br />NOW, THEREFORE, Be it resolved by the Cass County Board of Commissioners that <br />taking of the land in Reed Township, described as the West 33 feet of the East 133 feet <br />lying West of the North, South % % line located in the NE% of Section 2, Township 140 <br />North, Range 49 West of the 5th Principal Meridian, excepting all that portion lying within <br />65 feet of the North section line, said tract containing 1.95 acres more or less, is hereby <br />declared a public necessity. A special board consisting of the County Auditor, the County <br />Treasurer, and the County Register of Deeds shall fix the damages for the taking. <br /> <br />Dated at Fargo, North Dakota, this 20th day of July, 1998. <br /> <br />14. FLOOD BUY-OUT PROPERTIES, Demolition bid awarded <br />Mr. Berndt attended the bid opening held earlier today by the Lake Agassiz Regional <br />Development Corporation for demolition of Cass County flood buy-out properties. The apparent <br />low bidder is Northern Improvement Company. <br />MOT/ON, passed <br />Mrs. Quick moved and Mr. Meyer seconded to approve contract with <br />Northern Improvement Company in the amount of $219,114 for <br />demolition of flood buy-out properties, subject to contract documents <br />being available and subject to State's Attorney review. On roll call <br />vote, motion carried unanimously. <br /> <br />15. EMPLOYEE SALARIES, Budget figure adopted <br />Sheriff Don Rudnick, on behalf of Cass County's department heads, presented a salary <br />adjustment recommendation of 2.5% for next year's cost of living increase, based upon the <br />Consumer Price Index rate of inflation of 2.3%. <br /> <br />Mr. Meyer felt the board should consider using the actual amount of 2.3% as the budget figure. <br />As far as law enforcement is concerned, and possibly other departments, Mr. Rudnick said the <br />county is still below average on salaries. Mrs. Schneider recommended using the 2.5% <br />recognizing the figure may be adjusted at budget time. <br />MOT/ON, passed <br />Mrs. Quick moved and Mr. Koenig seconded to approve for budget <br />purposes the department head group's recommendation to adjust the <br />county's pay scale by 2.5% for the year 1999, based upon the <br />Consumer Price Index. On roll call vote, motion carried unanimously. <br /> <br />16. JAIL RECOMMENDATIONS, Agenda order reversed on this tODic <br />MOT/ON, passed <br />Mr. Koenig moved and Mr. Meyer seconded to reverse the order of <br />agenda items on the jail recommendations. Motion carried. <br />
