Commission Minutes-February 17, 1998 1780 Mrs. Schneider asked for further discussion or any comments from the audience. Hearing none, she closed the discussion. MOTION, passed Mrs. Quick moved and Mr. Koenig seconded to adopt Resolution #1998- 5 as follows: On roll call vote, motion carried unanimously. RESOLUTION DECLARING PUBLIC NECESSITY TO TAKE LAND WHEREAS: Plans have been prepared to replace a bridge in sections 32 and 33 of Harwood Township; and WHEREAS: Additional property in section 32 of Harwood Township is required to construct the new structure and road to appropriate engineering standards; and WHEREAS: The Board of County Commissioners has been unable to purchase the land required at a price which the board deems reasonable; and WHEREAS: Section 24-05-09 and Section 24-05-10 of the North Dakota Century Code authorize the Board of Commissioners to purchase, acquire, take over, or condemn under the right and power of eminent domain, for such county, any and all lands which it deems necessary for improving any highway. NOW, THEREFORE BE IT RESOLVED, by the Cass County Board of Commissioners that taking ofthe land in Section 32 of Harwood Township, as described in the legal description attached to the resolution, is hereby declared a public necessity. A special board consisting of the County Auditor, the County Treasurer, and the County Register of Deeds shall fix the damages for the taking. RESOLUTION #1998-6, Spring road weight restrictions Mr. Berndt next presented a resolution to implement spring county road weight restrictions on February 23, 1998, based upon the weather forecast for the rest of the week. Mr. Meyer asked if this action would interfere with moving flood-damaged homes from rural subdivisions. Mr. Berndt said implementing these road restrictions does not preclude the issuance of a special permit for moving a home; however, he said those homes should be moved in the next 1-2 weeks because of the unseasonably warm weather. Mr. Goff asked about the Cass County Highway 1998 Spring Weight Restrictions Map as referenced in the resolution, and Mr. Berndt said a copy will be filed with the resolution. The map was reviewed earlier today at the County Road Advisory Committee meeting.
