<br />Commission Minutes-February 17, 1998 1780 <br /> <br />Mrs. Schneider asked for further discussion or any comments from the audience. Hearing none, <br />she closed the discussion. <br />MOTION, passed <br />Mrs. Quick moved and Mr. Koenig seconded to adopt Resolution #1998- <br />5 as follows: On roll call vote, motion carried unanimously. <br /> <br />RESOLUTION DECLARING PUBLIC NECESSITY <br />TO TAKE LAND <br /> <br />WHEREAS: Plans have been prepared to replace a bridge in sections 32 and 33 of <br />Harwood Township; and <br /> <br />WHEREAS: Additional property in section 32 of Harwood Township is required to <br />construct the new structure and road to appropriate engineering standards; <br />and <br /> <br />WHEREAS: The Board of County Commissioners has been unable to purchase the land <br />required at a price which the board deems reasonable; and <br /> <br />WHEREAS: Section 24-05-09 and Section 24-05-10 of the North Dakota Century Code <br />authorize the Board of Commissioners to purchase, acquire, take over, or <br />condemn under the right and power of eminent domain, for such county, any <br />and all lands which it deems necessary for improving any highway. <br /> <br />NOW, THEREFORE BE IT RESOLVED, by the Cass County Board of Commissioners that <br />taking ofthe land in Section 32 of Harwood Township, as described in the legal description <br />attached to the resolution, is hereby declared a public necessity. A special board <br />consisting of the County Auditor, the County Treasurer, and the County Register of Deeds <br />shall fix the damages for the taking. <br /> <br />Dated at Fargo, North Dakota, this 17th day of February, 1998. <br /> <br />14. RESOLUTION #1998-6, Spring road weight restrictions <br />Mr. Berndt next presented a resolution to implement spring county road weight restrictions on <br />February 23, 1998, based upon the weather forecast for the rest of the week. Mr. Meyer asked <br />if this action would interfere with moving flood-damaged homes from rural subdivisions. Mr. <br />Berndt said implementing these road restrictions does not preclude the issuance of a special <br />permit for moving a home; however, he said those homes should be moved in the next 1-2 weeks <br />because of the unseasonably warm weather. Mr. Goff asked about the Cass County Highway <br />1998 Spring Weight Restrictions Map as referenced in the resolution, and Mr. Berndt said a copy <br />will be filed with the resolution. The map was reviewed earlier today at the County Road Advisory <br />Committee meeting. <br />MOTION, passed <br />Mrs. Quick moved and Mr. Koenig seconded to adopt Resolution #1998- <br />6 as follows: On roll call vote, motion carried unanimously. <br />
