<br />Commission Minutes--January 5, 1998 1762 <br /> <br />Section 7: EFFECTIVE DATE: This ordinance shall be in effect from and after the date of <br />final passage by the Board of Commissioners for Cass County, North Dakota, <br />and its publication according to law. <br /> <br />PASSED by the Board of Commissioners of the County of Cass this 5th day of January, 1998. <br /> <br />16. ORDINANCE FIRST READING, Flood Damage Prevention <br />Keith Berndt, County Engineer, drafted a flood damage prevention ordinance in response to <br />a requirement for adoption of a flood plain management ordinance in order to complete the <br />enrollment process for the National Flood Insurance Program. Mr. Berndt indicated FEMA <br />(Federal Emergency Management Agency) and North Dakota State Water Commission <br />requirements make it important that Cass County adopt an ordinance in a timely manner. He <br />said there are some legal questions because the ordinance is written to apply only to those <br />unincorporated areas not included in another city or township floodplain ordinance. He has <br />referred the proposed ordinance to the State's Attorney for review. <br />MOTION, passed <br />Mrs. Quick moved and Mr. Meyer seconded to approve first reading <br />of a County Flood Damage Prevention Ordinance, and to publish a <br />summary of the ordinance in the official newspaper at least 20 days <br />prior to second reading/adoption. On roll call vote, motion carried <br />unanimously. <br /> <br />16. FLOOD ISSUES, Waiver request: Lake Agassiz Regional Development update: removal <br />process (Heritage Hills Homeowners Association) <br />Bonnie Johnson, County Coordinator, reported the Department of Housing and Urban <br />Development has granted Cass County's low-income waiver request at 27.6% based upon <br />financial information provided. The county had requested the waiver at 31.5%. <br /> <br />Irv Rustad, Lake Agassiz Regional Development Corporation, provided the tabulation of bids <br />received December 30, 1997, for the Cass County Phase I Hazard Mitigation Acquisition <br />Program. He said the sale generated about $148,000 and will save demolition costs on those <br />properties. Mr. Rustad said his committee is recommending a July 1st deadline for moving <br />the homes under this program. <br /> <br />Commissioner Schneider arrived at this time and chaired the meeting after this topic. <br /> <br />Diane Pilkington, Heritage Hills Subdivision, addressed the board at this time to express <br />concerns from her neighborhood of possible road damages while moving the homes and <br />future deterioration. Other residents from Heritage Hills present at today's meeting were <br />Warren Wilson, Craig Strehlow, Glenda Schmit; and Vern Muscha from Stanley Township. <br /> <br />On the road concerns, Mr. Berndt believes it is important to move the homes as quickly as <br />possible, preferably while the ground is still frozen, or else wait until the summer when the <br />road base regains its strength after spring thawing. He recommends a pre-haul and post-haul <br />inspection to determine any potential damages, for which the moving contractor should be <br />responsible. Mr. Goff agreed any road damages should be the responsibility of the contractor <br />doing the work, and commissioners should decide who will pursue the moving company if <br />there are disputes over road damages. <br />
