<br />Commission Minutes--February 6, 2006 3030 <br /> <br />Recognizing there was a good cross-section of people on the subdivision review committee, <br />Mr. Vanyo asked if there was any particular area that was more controversial than others. <br />Mr. Zimney responded that the river set-back requirement is a big change from the current <br />subdivision regulations, and the committee thinks this may be an area of concern and <br />possible opposition. He said another area that may generate further discussion is the <br />density restriction. <br /> <br />Mr. Vanyo asked if it appears that any developers are concerned about changes in the <br />subdivision regulations, and Mr. Zimney said he has not received any negative comments. <br /> <br />Rich Sieg, Highway Superintendent, was asked for his opinion on the subdivision ordinance, <br />and he believes this is a move in the right direction. <br /> <br />Jonathan Anderson, Assistant State's Attorney, prepared the language for Section 906, <br />Penalties and Violations, and was present at today's meeting. He and Mr. Burdick talked <br />with the board about zoning authority issues, and they have some technical aspects to work <br />through but suggested moving forward with the first reading. Mr. Bennett asked if they will <br />have the additional information ready by the second reading, scheduled for March 6th, and <br />Mr. Burdick said he would. <br />MOTION, passed <br />Mr. Vanyo moved and Mr. Wagner seconded to approve the first reading <br />of Ordinance #2006~1, Cass. County Subdivision Ordinance; and to <br />schedule the second reading and adoption for March 6, 2006, allowing <br />time for publishing a summary of the ordinance in the official newspaper <br />at least 20 days before the second reading. On roll call vote, the motion <br />carried unanimously. <br /> <br />9. COMMISSION POLICY MANUAL, Amend Section 8.10, Bid OpeninQ Procedures <br />Rich Sieg, Highway Superintendent, proposed a change in Commission Policy Section 8.10, <br />Bid Opening Procedure (for County Roads). Bonnie Johnson, County Coordinator, said the <br />change is needed to mirror state law for the paragraph that quotes North Dakota Century <br />Code 24-05-04. At Mr. Sieg's request, she said an addendum is included that would require' <br />informal bidding for the purchase of county road machinery and other articles, or any <br />contract for highway improvement, which is $50,000 or less. If the sum exceeds $50,000, <br />the county highway department would be required to follow the state bidding process. <br /> <br />After a highway department study in the late 1980's, Mr. Sieg said the department now has <br />more engineering staff and less equipment because more work is done through contracting. <br />Mr. Wagner said the board will have final approval of equipment acquisitions through the <br />county's purchase order process. He said the county uses an informal process to acquire <br />motor pool vehicles. <br />MOTION, passed <br />Mr. Wagner moved and Mrs. Sorum seconded to amend Commission <br />Policy Manual Section 8.10 to conform with North Dakota state law; to <br />make proper reference to the North Dakota "Contract Drafting and Review <br />Manual" published by the North Dakota Attorney General; and to include <br />an addendum to Section 8.10 allowing informal bidding for the purchase <br />of county road machinery and other articles, or any contract for highway <br />improvement, which is fifty thousand dollars and under. <br />
