Commission Minutes--July 21, 1997 1665 <br /> <br />Mrs. Quick asked if the loaded truck would have been within the limits of the permit which had <br />expired. Mr. Rustad said it would have been about 500 pounds over, however, he does not believe <br />that would have generated a fine. Mrs. Schneider asked if Mr. Rustad would have been issued <br />another permit if he had applied for one. Keith Berndt, County Engineer, said his department did <br />not grant any additional permits because they realized they were making a sacrifice to county roads <br />but felt the decision to issue the permits in the first place was warranted under the circumstances. <br />Instead of extending any permits, the County Highway Department raised some of the restrictions. <br /> MOTION, passed <br /> Mr. Meyer moved and Mrs. Schneider seconded to request the North <br /> Dakota Highway Patrol to return the $818 overload fine to the Rustad's. <br /> Discussion: As Highway Department portfolio commissioner, Mrs. Quick <br /> said she is concerned about the message this sends and she is hesitant <br /> to reduce the entire fine. At the call for the question and upon roll call <br /> vote, motion carried with Mrs. Schneider, Mr. Wieland and Mr. Meyer <br /> voting "Aye," Mrs. Quick opposing. <br /> <br />10. <br /> <br />FLOOD UPDATE, Re_nort by Lake Agassiz Regional Council <br />A written update was received earlier today from Irv Rustad, Lake Agassiz Regional Council, dated <br />July 21, 1997, concerning the County's Hazard Mitigation Application. FEMA (Federal Emergency <br />Management Agency) has been requested to do additional work on damage assessment claims due <br />to questions from the State Hazard Mitigation team. <br /> <br />11. <br /> <br />RESOLUTIONS #1997-19, 20, 21 AND 22, Street Improvement District ~97-1 (Round Hill) <br />Roger Fenstad, Moore Engineering Company, was present and stated that the bid opening for said <br />improvements is set for 10:00 AM on August 6, 1997, at the offices of Moore Engineering Company, <br />1042 14th Avenue East, West Fargo. He indicated the resolutions being presented today were <br />prepared by Brian Neugebauer, Ohnstad Twichell Law Firm. <br /> <br />County Engineer, Keith Bemdt, has been advised of the project and will continue to monitor it. <br />Goff, State's Attorney, said he is not aware of any concerns at this time. MOTION, passed <br /> Mrs. Schneider moved and Mrs. Quick seconded to adopt resolutions <br /> concerning Street Improvement District ~7-1 as follows: RESOLUTION <br /> #1997-19 APPROVING ENGINEER'S REPORT; RESOLUTION #1997-20 <br /> DIRECTING ENGINEER TO PREPARE PLANS AND SPECIFICATIONS; <br /> RESOLUTION #1997-21 APPROVING PLANS AND SPECIFICATIONS FOR <br /> IMPROVEMENTS IN STREET IMPROVEMENT DISTRICT NO. 97-1 OF THE <br /> COUNTY OF CASS; AND RESOLUTION #1997-22 DIRECTING AUDITOR TO <br /> ADVERTISE FOR BIDS. On roll call vote, motion carried unanimously. <br /> <br />John <br /> <br />12. <br /> <br />DEVIL'S LAKE-SHEYENNE-RED RIVER BASIN, Joint Exercise of Powers Agreement <br />A copy of the "Joint Exercise of Powers Agreement for cities, counties and water resource districts <br />in the Devils Lake Basin and along the Sheyenne and Red Rivers was furnished by the Cass County <br />water resource district office. James McLaughlin, Southeast Cass Water Resource District, was <br />present to answer any questions. He asked the county commission to appoint one representative <br />to serve on the Devils Lake-Sheyenne-Red River Basin Joint Powers Advisory Committee, which <br />is created in the joint powers agreement for the purpose of establishing a procedure to allow the <br /> <br /> <br />
