10. <br /> <br />11. <br /> <br />12. <br /> <br />Commission Minutes-May 5, 1997 1619 <br /> <br />MOTION, withdrawn <br />Mr. Koenig moved and Mr. Meyer seconded to accept the legal bill from <br />Wold, Johnson law firm for legal services provided to State's Attorney, <br />John Goff, in the amount of $7,021.11 and direct the County Auditor to <br />pay the bill at once. Discussion: Mr. Meyer said, as he understands it, <br />Mr. Goff did not receive information on the complaint and was forced <br />to hire an attorney. As far as the question of whether Mr. Goff is <br />considered an employee of the county, he believes when someone is <br />elected by a majority of the people who voted in Cass County, that <br />person becomes an employee of the county. Commissioners were in <br />agreement that closure to this matter is needed. Commissioners Quick <br />and Wieland, in agreement with Mrs. Schneider, expressed their <br />opinion that this motion is premature until a response is received from <br />the Attorney General. Mr. Wieland said he would not be opposed to <br />sending a second letter. Mr. Koenig was agreeable to withdrawing his <br />motion at this time and Mr. Meyer withdrew his second. <br /> <br />MOTION, passed <br />Mrs. Schneider moved and Mrs. Quick seconded to delay a decision <br />on accepting the legal bill from Wold Johnson law firm for legal <br />services provided to State's Attorney, John Goff, in the amount of <br />$7,021.11 until the county receives a response from the Attorney <br />General; and that a letter of clarification be sent to the Attorney General <br />asking the status of Mr. Goff as a county employee. At the call for the <br />question and upon roll call vote, the motion carried with four members <br />voting "Aye" and Mr. Koenig opposing. Mr. Wieland stated that copies <br />of the response from the Attorney General will be provided to Mr. Goff <br />and Mr. Feder immediately upon receipt and be placed on the agenda <br />for the following meeting after receiving it. <br /> <br />ODOR ORDINANCE, Deferred upon request of West Fargo City Attorney <br />Mr. Wieland received a telephone call today from Brian Neugebauer, West Fargo City Attorney, <br />regarding first reading of a proposed odor ordinance on the agenda. It appears Cass County <br />does not need to adopt such an ordinance, which was requested by the City of West Fargo, <br />because they can address the odor problems from the beef processing plant located within their <br />extra-territorial jurisdiction by enforcing their own odor ordinance. <br /> <br />VOUCHERS, Approved MOTION, passed <br /> Mr. Koenig moved and Mr. Meyer seconded to approve Vouchers No. <br /> 102,279 through No. 102,397. On roll call vote, motion carried <br /> unanimously. <br /> <br />WORKER'S COMPENSATION PREMIUM; FLOOD SITUATION; STATE'S ATTORNEY STAFF <br />POSITIONS; COMMUNITY INVOLVEMENT MEETING, Committee reports <br />Bonnie Johnson, County Coordinator, will be attending a Worker's Compensation seminar next <br />week in Fargo to satisfy a requirement under the risk management program for premium <br />reductions. <br /> <br /> <br />
