Commission Minutes--January 21, 1997 1573 <br /> <br />WHEREAS, Cass County continues to see costs mount and the potential for damages to public <br /> and private property and roads are beyond normal anticipation and budgeted funds; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that pursuant to Section 37-17.1-10 of the North Dakota <br />Century Code, the Board of County Commissioners does hereby declare a snow emergency for <br />all of Cass County. That all applicable emergency operating plans of the county are hereby <br />activated to save lives, protect public health and safety and protect improved property. <br /> <br />Dated at Fargo, North Dakota, this 21st day of January, 1997. <br /> <br />13. <br /> <br />ORDINANCE #1997-1 and #1997-2, Second reading/final adoption of school bus ordinances <br />This was the time and place advertised for second reading/final adoption of two ordinances <br />prohibiting the disobedience of school bus traffic control signals relating to the general rules of <br />the road. First reading of the ordinances was held December 16, 1996, and notice of proposed <br />ordinance was published in the county's official newspaper, The Forum, on December 30, 1996. <br /> MOTION, passed <br /> Mrs. Quick moved and Mrs. Schneider seconded to approve second <br /> reading and final adoption of School Bus Ordinance #1997-1 and #1997- <br /> 2 as follows: On roll call vote, motion carried unanimously. <br /> <br />CASS COUNTY GOVERNMENT <br />ORDINANCE #1997-1 <br /> <br />AN ORDINANCE PROHIBITING THE DISOBEDIENCE OF SCHOOL BUS TRAFFIC CONTROL <br />SIGNALS RELATING TO THE GENERAL RULES OF THE ROAD <br /> <br />WHEREAS, the County Commission has determined that there has been an increase in reports of <br /> disobedience of traffic rules relating to school buses; and <br /> <br />WHEREAS, the Board of County Commissioners has an obligation to provide for the protection of <br /> citizens of Cass County, including the minor children who will ride on school buses; and <br /> <br />WHEREAS, <br /> <br />existing state laws have not adequately protected the citizens of Cass County and this <br />ordinance will be in the interest of public health, safety, and will help obtain the foregoing <br />objectives; <br /> <br />NOW, THEREFORE, be it ordained by the Board of Cass County Commissioners that an ordinance <br />prohibiting the disobedience of school bus traffic control signals is hereby enacted as follows: <br /> <br />Section 1. Enactment <br />Ordinance 1997-1 of the Cass County Ordinances is hereby enacted to read as follows: <br /> <br />No driver of a motor vehicle shall pass a school bus while that school bus has <br />activated flashing red lights, stop sign control arm, or safety strobe lights. <br /> <br />No driver of a motor vehicle shall pass a school bus in the oncoming lane while that <br />school bus has activated flashing red lights, stop sign control arm, or safety strobe <br />lights. <br /> <br /> <br />
