11. <br /> <br />Commission Minutes--November 18, 1996 1541 <br /> <br />The following request is a grant for law enforcement equipment and to enhance security, <br />according to the Sheriff. The grant requires an advisory board to provide input into the use of <br />these funds. <br /> MOTION, passed <br /> Mr. Wieland moved and Mrs. Schneider seconded to accept the 1996 <br /> Law Enforcement Block Grant funds in the amount of $18,$14.00 and <br /> authorize the chair to sign the award documentation and request for <br /> payment forms. On roll call vote, motion carried unanimously. <br /> <br />The last request is a grant for the hiring of a new deputy in order to assign an existing officer to <br />gang enforcement. <br /> MOTION, passed <br /> Mrs. Schneider moved and Mr. Wieland seconded to accept the 1996 <br /> Universal Hiring Grant and authorize the chair to sign the award <br /> documentation. On roll call vote, motion carried unanimously. <br /> <br />STREET IMPROVEMENT DISTRICT NO. 96-1, Public hearing held <br />A public hearing was advertised for this date and time on the assessment list for Street <br />Improvement District No. 96-1 as confirmed by the Special Assessment Commission of the <br />County of Cass. Attorney Daniel Twichell was present representing the street improvement <br />project, and he outlined how the Special Assessment Committee arrived at their conclusions. <br /> <br />Commissioners received copies of a "Notice of Appeal to Cass County Commission of the Action <br />of the Special Assessment Commission on Cass County Street Improvement District No. 96-1 ." <br />Names and addresses of 23 property owners, represented today by Attorney Edmund Vinje, II, <br />were listed on the appeal. <br /> <br />Mr. Vinje addressed the county commission at this time, and reviewed the reasons for the appeal. <br />He said his group does not feel the assessments were made proportionately according to the <br />benefit received, and he referred to the legal process that was followed. He also made reference <br />to the turn-around which the county required at the end of the development and said the county <br />should pay for it because the residents did not request it. He said the resolution establishing the <br />district did not include the turn-around. Mr. Wieland said the turn-around was included in order <br />to bring the road up to current safety standards. Whenever road improvements are made, <br />including special assessment districts, the county requires that they meet the current standards. <br /> <br />Mr. Twichell outlined the procedure that was followed according to county policy and state law. <br /> <br />Gregory Selbo, Nilles Law Firm, appeared on behalf of a resident in Chrisan Glen and developers <br />of Forest River 3rd Subdivision. They believe the system has worked the way it should and that <br />the benefits are properly assessed. <br /> <br />All members of the Special Assessment Committee were present; and chairman of the group, <br />Jake Gust, said the committee met a number of times on this issue and voted unanimously to <br />approve these assessments. <br /> <br />Another resident, Connie Hoffman, said she and her husband attended several meetings on this <br />project, and they understand and agree with the assessments. <br /> <br /> <br />
