19. <br /> <br />Commission Minutes--October 21, 1996 1530 <br /> <br />Mr. Wieland said he wants to have a member on the gang task force and, for a number of years, <br />he wanted to move the State's Attorney investigator position to the Sheriff's Department so that <br />person could be a licensed peace officer and have more authority. He supports the concept <br />today but is concerned about working out the details because of the need for investigative work <br />in the State's Attorney's Office also. <br /> <br />Mr. Eckert said he has been supportive of the gang task force, however, he suggested having the <br />two department heads work out the details and report back at the next Commission meeting. <br />MOTION, passed <br /> Contingent upon the drafting of the appropdats job description and any <br /> other relevant personnel documents, Mr. Ness moved and Mrs. <br /> Schneider seconded to assign an existing officer to the gang task <br /> force. Details of the arrangement shall be worked out between the <br /> State's Attorney and the Sheriff. Discussion: Mr. Wieland said this <br /> motion does not state that the investigator position will be moved to <br /> the Sheriff's Department, and he believes this is an important part of <br /> the motion. <br /> AMENDED MOTION, failed <br /> Mr. Wieland moved and Mrs, Schneider seconded to amend the motion <br /> whereby the State's Attorney investigator position, and all of the <br /> relevant financial aspects of that particular position, be moved to the <br /> Sheriff's Department. Discussion: Mr. Ness said the State's Attorney <br /> has volunteered that position and this is the intent of the main motion. <br /> Mr. Goff said his proposal was to offer the investigator position to be <br /> a part of the gang task force or to be assigned to the Sheriff's <br /> Department in exchange for another officer being dedicated to the task <br /> force. Mr. Ness asked if the first motion gives him the latitude to work <br /> with the Sheriff to come to an agreement between the two departments, <br /> and Mr. Goff said it does. If the Commission wants to take the <br /> investigator position out of his office, Mr. Goff said that is a different <br /> issue. Mrs. Schneider asked how soon the Sheriff and State's Attorney <br /> could work out the details, and they both thought they could get <br /> together by the next Commission meeting. Mr. Eckert suggested that <br /> they work out the details and bring it back to the Commission before <br /> any action is taken today. At the call for the question and upon roll call <br /> vote, the amended motion failed on a 4-1 vote with only Mr. Wieland <br /> voting "Aye." At the call for the question and upon roll call vote, the <br /> main motion carried with Mr. Ness, Mrs. Schneider, Mrs. Toussaint and <br /> Mr. Wieland voting "Aye"; Mr. Eckert opposing. <br /> <br />ORDINANCE PROPOSED, School bus ordinance <br />A letter was received from Marvin Leidal, Superintendent of the West Fargo School District, <br />requesting consideration for adoption of a Cass County ordinance relative to increasing the fine <br />for passing a school bus when its red lights are flashing and the "stop" arm is extended. Mr. <br />Leidal was present today, and Commissioners received a copy of the City of Fargo ordinance <br />which allows for a fine up to $500 for violating this section. <br /> <br /> <br />
