Minutes--October 12, 1992 939 <br /> <br />NORTH DAKOTA DEPARTMENT OF TRANSPORTATION (NDDOT), Gardner structure <br /> MOTION, passed <br /> Mr. Risher moved and Mrs. Toussaint seconded to authorize <br /> the Chairman to sign right of way certificate and agreement <br /> with NDDOT for the construction and maintenance of Project <br /> BRC 0914(51), Cass County Red River, 4 miles south and 6 <br /> miles east of Gardner. On roll call vote, motion carried <br /> unanimously. <br /> <br />RESOLUTION OF CONDOLENCES, Family of the late Roger Erickson <br /> MOTION, passed <br /> Mr. Risher moved and Mrs. Toussaint seconded to adopt the <br /> following Resolution of Condolence to the family of the <br /> late Roger Erickson, who served on the Cass County School <br /> Reorganization Committee for 20 years, according to County <br /> Superintendent Bruce Hoers: On roll call vote, motion <br /> carried unanimously. <br /> <br /> W~EREAS, the Board of Cass County Commissioners has learned of <br />the death of Roger Erickson of Tower City, North Dakota; and <br /> <br /> WHEREAS, Roger Erickson served for 20 years as a member of the <br />Cass County School Reorganization Committee. <br /> <br /> THEREFORE, BE IT RESOLVED, That the Board of Commissioners of <br />Cass County, North Dakota, does hereby express its heartfelt <br />condolences to the family of the late Roger Erickson. <br /> <br /> BE IT FURTHER RESOLVED, That this resolution be inscribed upon <br />the permanent records of the proceedings of the Board of Cass County <br />Commissioners and a copy forwarded to his family. <br /> <br />Dated at Fargo, North Dakota, this 12th day of October, 1992 <br /> <br />RESIGNATION OF GEORGE GRIFFETH, From Cass County Housing Authority <br /> MOTION, passed <br /> Mr. Risher moved and Mrs. Toussaint seconded to accept the <br /> resignation of George Griffeth from the Cass County Housing <br /> Authority, effective this date, and to send a letter <br /> thanking him for his service. On roll call vote, motion <br /> carried unanimously· <br /> <br />HOME RULE, Attorney General opinion <br />Cass County Government received a copy of a letter addressed to the <br />Mayors of Fargo and West Fargo from Attorney General Nicholas Spaeth <br />on their question about the effect of county home rule on city <br />ordinances. According to the opinion, State's Attorney John Golf said <br />a county home rule ordinance will not supersede a city ordinance. Mr. <br />Goff said it is clearly set out in State statutes. <br /> <br />County Coordinator Bonnie Johnson said the Cass County Home Rule <br />Charter Committee researched this item also and found that State <br />statutes do not allow a county home rule ordinance to supersede a city <br />ordinance. She said written opinions were received from the Fargo and <br />West Fargo City Attorneys providing the same opinion. <br /> <br /> <br />
