Comm. Minutes--October 5, 1992 935

an additional appeal through the North Dakota Central Personnel
Division if the Commission votes to uphold her decision.

Mr. Wieland said one option is to order an investigation, and he
understands that the Commission would then need to respond on or about
October 27, 1992. The other options would be to uphold or to over-
ride the decision of the department.

As portfolio commissioner, Mrs. Toussaint said she received a letter
from Mr. Yenkosky in September and she responded to his requests.
Commissioners received a letter dated September 28, 1992, declining
Mrs. Toussaint's offer.
MOTION, passed
Mrs. Toussaint moved and Mr. Shannon seconded to uphold the
portfolio commissioner's recommendation and the Social
Service Director's decision to terminate Joseph Yenkosky.
Motion carried on roll call vote with three members voting
"Aye," Mr. Wieland and Mr. Risher opposing.

15.

JOINT DISPATCH, Intergovernmental Agreement/Phase I
Mr. Wieland said the Joint Dispatch Committee is continuing to pursue
a joint agreement between Cass County Government and the cities of
Fargo and West Fargo. Copies were provided of an Intergovernmental
Agreement, Phase I. Mr. Wieland said the next meeting will be held
October 13, 1992, at the Juvenile Justice Center, and attorneys
representing all three entities have been invited to attend.

Mr. Shannon suggested expanding the next meeting to include all
members of the Cass County Commission, the Fargo and West Fargo City
Commissions. Mr. Wieland said the Joint Dispatch Committee can decide
when to include the full commissions, and he will bring it up at the
next meeting.

16.

TAX-FORFEITED PROPERTY, Appraisal/hearing date set/annual sale
County Auditor Michael Montplaisir provided a letter and a list of
tax-forfeited property with the total amount of taxes, special
assessments, penalties, interest and costs (with the exception of
about 11 properties that were acquired in previous years). He
suggested putting a value of $1.00 on each of the lots that remain
unsold from previous years in order to get them back on the tax rolls.
He said Cass County Government also owns some lots in Forest River
Subdivision, but he thinks those lots should be retained at this time.

Mr. Montplaisir said the current owners of these properties on the tax
sale list have until the time of the sale to redeem their property by
paying an amount sufficient to cover all taxes, special assessments,
penalties, interest and costs for the delinquent years and for the
current year. The time of the sale is 10:00 AM on November 17, 1992.
MOTION, passed
Mr. Shannon moved and Mr. Eckert seconded to set the value
of the tax-forfeited properties as outlined in the list
provided by the County Auditor's Office; and to set the
hearing date on the value of property as 3:30 PM on
November 2, 1992. On roll call vote, motion carried
unanimously.
