Minutes--September 21, 1992 922 <br /> <br />13. <br /> <br />RESOLUTION #1992-6, Platting and Land Subdivision Regulations amended <br />County Planner Earl Haugen said the Cass County Planning Commission <br />held a public hearing at their September 3rd meeting on proposed <br />amendments to the Platting and Land Subdivision Regulations for Cass <br />County, North Dakota. No one appeared to comment on the amendments. <br /> <br />Mr. Haugen said the proposed amendments would clarify how roads are <br />vacated, would specifically include the term subdivision in the <br />violation subsection, and would allow for the use of a new form to <br />record simple subdivisions (the result would be less costs to the <br />public in recording simple subdivisions, and the costs would be <br />similar to those of platting an auditor's lot). MOTION, passed <br /> Mr. Eckert moved and Mr. Risher seconded to adopt <br /> Resolution #1992-6, which will amend the Subdivision <br /> Regulations to clarify how roads are vacated, will include <br /> the term subdivisions into the violation subsection, and <br /> permit the use of a new form to record simple subdivisions. <br /> On roll call vote, motion carried unanimously. Resolution <br /> is on file in the Auditor's Vault. <br /> <br />14. <br /> <br />SHERIFF'S DEPARTMENT EMPLOYEE TERMINATION, Appeal to County Commission <br />by Jerry Mickish <br />Sheriff Donald Rudnick read a letter which he addressed to the Cass <br />County Board of Commissioners regarding Jerard Mickish' employment <br />termination, which was effective July 27, 1992, following an incident <br />which resulted in an inmate escape from the Cass County Jail on July <br />20, 1992. In his letter, Sheriff Rudnick cited documented incidents <br />and disciplinary problems involving Mr. Mickish during the past year. <br /> <br />Jerry Mickish was present and represented by his attorney, John <br />Schneider. Mr. Schneider outlined the events of July 20, 1992, as <br />told to him by Mr. Mickish, and he provided a diagram of the <br />recreation area outside the jail. He said the door that Mr. Mickish <br />left unlocked is the entrance used by work release inmates who return <br />to the jail about the time that the escape took place. He admits that <br />Mr. Mickish did not lock the gate but he would have done things <br />differently if he had thought about it. Most relevant to the case <br />is that Mr. Mickish did not know the history of the inmate who <br />escaped, Mr. Schneider said. <br /> <br />Mr. Schneider requested that the Cass County Commission reverse the <br />decision of the Sheriff's Department and re-instate Mr. Mickish. <br /> <br />Commissioners were given an opportunity to ask questions, and they <br />discussed the "Fair Treatment Policy" in the Cass County Personnel <br />Policy Manual. According to Step IV in said policy, the full County <br />Commission or their designee shall investigate the complaint and <br />render a final decision, which shall generally be made within thirty <br />(30) working days of receipt of the written complaint. Mr. Wieland <br />said-the Commission received the complaint on September 10, 1992. <br /> MOTION, passed <br /> Mr. Shannon moved and Mr. Risher seconded to review the <br /> circumstances and make a decision in the next five days as <br /> to whether the whole commission will hear the matter or <br /> select a designee; and render a response by October 10, <br /> 1992.
