Feder, Chairman, 29 North University Drive, Fargo, North <br /> <br />Dakota, 58102, (hereinafter "Beth E1"), FARGO HEBREW CONGREGATION <br /> <br />CEMETERY, c/o Steve Halverson, Heartland Trust Co., 1202 2ih Street South, Fargo, North <br /> <br />Dakota, 58103, (hereinafter "Fargo Hebrew"), HOLY CROSS CEMETERY ASSOCIATION, <br /> <br />1502 32nd Avenue North, Fargo, North Dakota, 58102, (hereinafter "Holy Cross"), the <br /> <br />MUNICIPAL AIRPORT AUTHORITY of the City of Fargo, North Dakota, a public body <br /> <br />corporate and politic c/o Shawn Dobberstein, PO Box 2845, Fargo, North Dakota 58108-2845 <br /> <br />(hereinafter "MAA") and CASS COUNTY NORTH DAKOTA, PO Box 2806, Fargo, North <br /> <br />Dakota, 58108 (hereinafter "County"), <br /> <br />WITNESSETH: <br /> <br />WHEREAS, All of the above parties have agreed on a 32nd Avenue North Paving Project <br /> <br />of the East-West Avenue lying adjacent to the cemeteries; and <br /> <br />WHEREAS, the parties have agreed that a change order between MAA's contractor, <br /> <br />Shafer Contracting Company, Inc. will be available for this project thus resulting in lower project <br /> <br />cost; and <br /> <br />WHEREAS, each of the parties wiII be contributing to the cost of such paving project; <br /> <br />and <br />
