11. 12. 13. Comm. Hinutes--July 15, 1991 711 CONTRACT WITH CENTRE, INC., Approved subject to deletion of paragraph Mr. Golf reviewed the contract submitted by Centre, Inc. He does not recommend approval of the contract as written because of the second paragraph, clause XXIII on Indemnity, which states that Cass County would agree to defend any claims or legal actions brought against the County and/or Centre, Inc. He recommends the Commission approve the contract subject to deletion of that paragraph. Hr. Shannon asked how much Cass County uses the services of Centre, Inc. Sheriff Rudnick said Cass County has approximately 5 to 6 detox prisoners per year that are housed at the facility. MOTION, passed Mr. Shannon moved and Mr. Eckert seconded to approve contract with Centre, Inc., subject to deletion of paragraph #2, section XXIII, the Indemnity clause based on the assumption that this is in agreement with Centre, Inc. On roll call vote, motion carried unanimously. CORRESPONDENCE, Received and filed MOTION, passed Mr. Shannon moved and Nr. Eckert seconded to receive and file correspondence as outlined by the secretary as follows: Motion carried. - City of Fargo Customs Activity Report; - Personnel Action Report for the month of June, 1991; letter from North Dakota Association of Counties to Chairman Shannon regarding legislative questions concerning the North Dakota Insurance Reserve Fund. ADJOURNMENT MOTION, passed On motion by Mr. Shannon, seconded by Mr. Eckert, and all voting in favor, the meeting adjourned at 3:50 PM.
