Minutes--June 17, 1991 692 MOTION, passed Mrs. Toussaint moved and Mr. Risher seconded that Cass County seek a mutually convenient time for the County to meet with Fargo and West Fargo to consider the possibility of developing a modest budget which would be used 'to delineate some of the variables that are yet unknown. Discussion: Mr. Risher said this can be a cornerstone to a joint law enforcement center, and this should be kept in mind. At the call for the question and on roll call vote, the motion carried unanimously. 13. COUNTY OFFICIALS VISITING, Introductions Mr. Wieland said the North Dakota County Commissioners Association board of directors met in Fargo earlier today, and he introduced Richard Bendish, Andy Hagle, Plus Krenzel and North Dakota Association of Counties Executive Director, Mark Johnson. 14. PLAT APPROVAL, Hearing on CRW (Cass Rural Water) "M" Subdivision plat The chairman declared a public hearing on application for subdivision approval submitted by Cass Rural Water (CRW) on behalf of Don Mergner. No one present asked to speak to the commission during the public hearing so Chairman Shannon asked County Planner Earl Haugen to proceed. Mr. Haugen said the Plat of CRW "M" Subdivision complies with township and Cass County subdivision regulations. He has verbal approval of the Rush River Water Resource District. MOTION, passed Mr. Wieland moved and Mrs. Toussaint seconded to approve the final plat of the CRW "M" Subdivision on condition that the Rush River Water Resource District approve the plat; and allow the Chairman to sign the final plat. On roll call vote, motion carried unanimously. 15. POLICY, Creation of special assessment districts for asphalt roads Earl Haugen submitted an amended policy of special assessments for the asphalting of roads as recommended by an ad hoc committee and approved by a majority of the members of the Cass County Planning Commission. The States Attorney also reviewed the policy. MOTION, passed Mr. Wieland moved and Mr. Risher seconded to approve the proposed amendments to the Cass County Policy on the Creation of Special Assessment Districts for the purpose of Asphalting Roads. On roll call vote, the motion carried with four members voting "Aye", Mr. Eckert opposing because he thought the 50% up-front cost of estimated improvements on undeveloped lots should be higher. 16. STATE HIGHWAY DEPARTMENT, Railroad crossing upRrades, Federal hiKhwa~ legislation, "model" Droject commended Dave Leftwich, Secondary Roads Engineer with the North Dakota Department of Transportation, was introduced by County Engineer Don Richards. He was here to answer questions about railroad crossing maintenance and upgrading. He said his department feels it is the responsibility of the railroad to maintain ail railroad crossings~ and he provided copies of North Dakota Century Code 49-11-0~.4.
