Comm, Minutes--October 16, 1990 <br /> <br />552 <br /> <br />17, <br /> <br />18. <br /> <br />19. <br /> <br />PLAT OF C L SUBDIVISION, DURBIN TOWNSHIP <br />County Planner Earl Haugen wrote a 'letter to the Commission dated <br />October 12, 1990, indicating the County Planning Commission approved <br />final plat of the C L Subdivision located in Section 12, Durbin <br />Township, with three conditions as follows: 1) provide a refinement <br />agreement of the Amoco Oil Pipe Line easement; 2) construct drainage <br />and dike with the slope of 4:1 as per approval by Maple River Water <br />Resource District; 3) comply with all township regulations and codes. <br /> <br />Mr. Shannon asked Mr. Haugen if there is a disclaimer or something on <br />the plat that tells prospective buyers whose responsibility it is for <br />the roads in the subdivision. Mr. Haugen said the road system is <br />maintained by the State of North Dakota, but the final plat doesn't <br />have a disclaimer to that effect. Mr. Shannon said he can think of <br />no instance where this shouldn't be included on all plats. NOTION, passed <br /> Mr. Wieland moved and Mr. Eckert seconded to approve the <br /> final plat of C L Subdivision with conditions as stated by <br /> County Planning Commission, authorize the Chairman to sign <br /> the plat, and adding a disclaimer that Cass County will not <br /> be responsible for roads in the subdivision. Mr. Shannon <br /> asked the County Planner to incorporate this on all plats <br /> approved by the County. On roll call vote, motion carried <br /> unanimously. <br /> <br />LEGISLATIVE ISSUES, Effect on Social Services, A~enda for October 27 <br />Mrs. Toussaint said County Social Services started some activity on <br />.recommendations from the "model" report concerning legislation. She <br />said the State Department of Human Services informed the County <br />Social Service Director that proposed State budget cuts for the next <br />biennium will result in about $400,000 of increased obligations to <br />Cass County for social service programs. Mr. Shannon said, in regard <br />to the December 5th vote, the State seems to interpret the vote as <br />not cutting state spending but having counties pay for the services. <br /> <br />Mr. Shannon reminded Commissioners of recent correspondence from Mike <br />Montplaisir concerning additional pressures on county property taxes <br />at the federal 'level. <br /> <br />Mr. Wieland reported that a meeting with legislative candidates and <br />department heads on potential legislative issues has been scheduled <br />for October 27th at 1:30 p.m. in the Juvenile Justice Center. <br /> <br />JAIL INMATES, Work detail discussed <br />Mr. Sondrall asked how approval was obtained for having prisoners <br />clean rubbish from the former sheriff residence. Mr. Shannon said <br />Sheriff Rudnick and Walt Willis, Chief Correctional Officer, pledged <br />their cooperation in using prisoners for certain work detail. The <br />States Attorney verified that this could be done if prisoners were <br />covered under Workmen's Compensation. Mr. Shannon reviewed it with <br />Mike Montplaisir and Geoff Riches, who inquired of State Job <br />Services. They informed the County of the legal framework for doing <br />this so the County is covered from any liability. Mr. Sondrall asked <br />about using prisoners to clear snow from sidewalks, and Mr. Shannon <br />suggested that he talk to Mr. Willis about it. <br /> <br /> <br />
