<br />Commission Minutes--November 7, 2005 2998 <br /> <br />Mr. Vanyo presented the 2005 Click It or Ticket award today to Sheriff Don Rudnick, <br />Lieutenant Mike Argall and Patrol Officers Bruce Renshaw and Jesse Jahner in recognition <br />of reaching 82.7% safety belt use and for saving lives and reducing injuries on North Dakota <br />roadways. <br /> <br />Lieutenant Argall said the sheriffs department practices zero tolerance on seat belt usage, <br />and he said Deputies Jahner and Renshaw lead the department, and the state with the <br />exception of the highway patrol officers, in the number of tickets issued to enforce the <br />state's seatbelt law. Commissioners were asked to support future legislation making <br />seatbelt enforcement a primary law, which would allow law enforcement officers to stop <br />vehicles solely because of seatbelt violations. <br /> <br />17. RESOLUTION #2005-17, MIDA Bond Application of Plains Art Museum <br />Attorney James Stewart was present to answer questions concerning the application of <br />Plains Art Museum for MIDA Bond financing in an amount not to exceed $2 million for <br />refunding outstanding bonds issued by the City of Fargo, Series 1996 Bonds. Proceeds of <br />the Series 1996 Bonds were used to finance a portion of the cost of renovating a building <br />located at 704 First Avenue North in Fargo. <br /> <br />Mr. Stewart said a public hearing is needed because Plains Art Museum is extending the <br />maturity date of the bonds. Initially, they had not planned to change the maturity so a public <br />hearing would not have been necessary. He is now requesting approval of a resolution <br />submitted to Cass County on October 27, 2005 and for the board to schedule a public <br />hearing on December 5, 2005. Mr. Stewart will provide any additional documentation to <br />State's Attorney Birch Burdick. <br /> <br />Mr. Wagner asked about the bond limit, and County Auditor Michael Montplaisir said the two <br />MIDA Bond requests today will bring the total bond debt to $9.9 million, just under the $10 <br />million annual limit. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Pawluk seconded to adopt Resolution #2005- <br />17 Approving the Issuance of Museum Facilities Refunding Revenue <br />Bonds (Plains Art Museum Project) Series 2005, and set a public hearing <br />for December 5,2005, subject to state's attorney review. On roll call vote, <br />the motion carried unanimously. <br /> <br />18. RESOLUTION #2005-18, MIDA Bond application of NDSU Development Foundation <br />Attorney James Stewart was present to answer questions concerning the application of <br />NDSU Development Foundation for MIDA Bond financing in an amount not to exceed $3.5 <br />million for the purpose of financing the construction and equipping of office space, locker <br />rooms, meeting rooms and related facilities located in the FargoDome at 1800 North <br />University Drive in Fargo. <br /> <br />Mr. Wagner asked why Cass County is being approached for the MIDA Bond issue at the <br />FargoDome, and Mr. Stewart said the county's interest rate is better than the city can offer. <br />
