Mr. Shannon moved and Mr.
Wieland seconded to table the motion until the States
Attorney reviews the situation. Motion carried.

11. OVERTIME EXEMPTIONS, Sheriff's administrative staff
Sheriff Don Rudnick was present along with several of his
administrative staff regarding their request in a letter to the
Commission dated July 31, 1989, for review of overtime exemptions.
Sheriff Rudnick stated that he does not have a problem with the
exemption status for the administrative staff's normal work time but
feels they should be paid for extra duty events that are contracted
through the County and require the use of administrative staff. He
stated that the North Dakota State University is now contracting with
Cass County to police home footbal'l games, and they want one
supervisor present also. He stated that last'year, the County took
in $19,000 from outside agencies and paid out $14,000 in salaries.

Mr. Wieland felt the Commission needs to be very careful about
granting any overtime exemptions, not that he doesn't feel some
adjustments may need to be made. He felt that a personnel director
should review this and if it is found that an adjustment should be
made, it could be retroactive to when the plan took effect. He asked
the Sheriff if they would still want the overtime exemption for extra
duty events even if a salary adjustment doubled their salary, and Mr.
Rudnick stated that they would want overtime pay if the County
continues to contract for these events outside of their normal work
routine. Mr. Wieland questioned whether the County should continue
to contract for special duty events. Mr. Rudnick felt the County may
be called anyway to handle a situation which otherwise could be
avoided, and probably without the agency paying them to be there. He
stated that an alternative may be to promote some sergeants to
supervisors.
