Comm. Hinutes--May 2, 1989 242

5. SHERIFF'S DEPARTMENT, Represented by attorney
Attorney Robert Feder was present representing the County Sheriff's
Department and asking that the report be rejected because they feel
the classifications and salaries are wrong and unfair, and they felt
the committee used different methods of computing classifications for
the Sheriff's Department than for other departments. Mr. Feder
stated that this report ignores and destroys the existing chain of
command in the Sheriff's Department, and he requested that the pay
scale be rejected and referred to another committee or back to the
same committee with instructions to treat all County employees the
same.

One recommendation is that a grievance committee and a procedure be
established so that any employee has an opportunity to discuss this
matter.

6. PERSONNEL POLICY COMMITTEE, Time-table adopted MOTION, passed
Mr. Shannon moved and Mrs. Toussaint seconded to adopt the
recommended time table for Items 1, 2, 3, and 4 in the
"Report of the Committee on Personnel Policies" as follows:

1) Accept the report of the Subcommittee.

2) Establish a grievance procedure and grievance committee.
The Commission should direct that all grievances be
filed with the Personnel Office no later than 5:00 p.m.
on Friday, May 12, 1989. The Commission should require
that the proposed grievance form be utilized by any
employee filing a grievance. The Commission should
appoint the recommended grievance committee to hear such
grievances and report their findings to the Commission
no later than Friday, May 26, 1989.

3) Comments regarding overtime should be solicited from the
Road and Sheriff's Departments. Specifically, those
comments should include:
(a) The amount of reimbursement received by Cass County
for special event items, such as concerts, football
games, working on private roads or driveways, et
cetera. Also included should be the cost incurred
by the County for providing such service.
(b) Each of the departments affected should submit their
recommendations concerning procedures for storm days
and holiday pay.
(c) Recommendations should be submitted by each of the
affected departments as to how overtime hours are to
be computed, i.e., on a 40-hour week, 160-hour, 28-
day cycle, et cetera.

4) The Personnel Assistant should be directed to contact
the appropriate governmental agency for a determination
as to which of the County employees in proposed pay
grade 21 or above are exempt from the requirement of
overtime under the Fair Labor Standards Act.
