98 <br /> <br /> The Commission received correspondence, also addressed to <br />County Engineer Don Richards, from States Attorney Robert Hoy dated <br />July 5, 1988, regarding hiring of additional trucks. <br /> <br /> A letter was received from Assistant States Attorney James <br />Twomey dated July 8, 1988, regarding petition for incorporation of <br />Oxbow, North Dakota. Attorney for the petitioners, Greg Selbo, was <br />present and Mr. Twomey represented the States Attorney's Office. <br />County Planner Earl Haugen was also present. Members of the <br />Commission expressed their opinions on the matter. Mr. Mort Mazaheri <br />was present as a member of the County Planning Commission and also <br />the Fargo City Commission. He agreed with Commissioner Stanton's <br />objection that what the Commission decides on Oxbow may affect the <br />outcome of an appeal in District Court by the petitioners for the <br />incorporation of Round Hill. Mr. Twomey stated that there could be <br />an attempt to compare the two but these are separate issues. <br />Mr. Larson moved and Mr. Sondrall seconded to allow the incorporation <br />of Oxbow, North Dakota. At the call for the question and upon roll <br />call vote, the motion carried with four members voting "Aye" and <br />Mrs. Stanton opposing. <br /> <br /> Mr. Wieland moved and Mr. Larson seconded that the States <br />Attorney's Office be requested to prepare a draft of the written <br />findings and to inform the Commission as to the next procedures for <br />incorporation of Oxbow, North Dakota, under Stats law. Motion <br />carried. <br /> <br /> The following four nominees from the North Dakota Judicial <br />Nominating Committee were considered for appointment of County Judge <br />to replace Donald Cooke: Gary S. Gronneberg, Larry F. Nordick, Frank <br />L. Racek, and Donald H. Shoop. Mr. Larson moved and Mr. Sondrall <br />seconded to appoint Frank L. Rafek as County Court Judge until <br />December 51, 1988, to replace Donald Cooke. On roll call vote, the <br />motion carried unanimously. <br /> <br /> Mr. Larson moved and Mr. Sondrall seconded to set the salary for <br />Frank L. Racek as County Judge at 85~ of the District Court Judges <br />base salary. On roll call vote, the motion carried unanimously. <br /> <br /> Administrative Assistant <br />nothing to report. <br /> <br />Diana Muraok stated that she had <br /> <br /> Concerning appointments to various boards where terms are <br />expiring, the matter will be placed on next week's agenda. <br /> <br /> Upon the request of Tom Jensen, Director of Social Services, <br />Mrs. Stanton moved and Mr. Larson seconded to authorize hiring staff <br />replacement for an Eligibility Specialist I in pay grade 17 at a <br />salary range of $1,161-$1,759. Motiom carried. Mrs. Stanton stated <br />that a report from the Director of Administrative Services informed <br />the Commission that the Social Services Department is not following <br />County personnel procedures when hiring new employees. She reminded <br />Mr. Jensen to follow the County personnel policy. <br /> <br /> <br />
