<br />LEASE AGREEMENT <br /> <br />This lease is made and entered into by and between The Nordick Group, Inc. <br />"NORDICK," and Cass County, "TENANT." <br /> <br />NORDICK owns a multi-tenant commercial building located at 900-904 and 910- <br />916 Page Drive, Fargo, ND, on real property described as follows: <br /> <br />LOT 7, BLOCK 3 OF THE WESTRAC SECOND ADDITION <br /> <br />TENANT intends to occupy the unit identified as 904 Page Drive which comprises 3,750 <br />square feet on the east half of the 7,500 square foot building. Such unit shall <br />hereinafter be referred to as "PROPERTY." TENANT intends to store and maintain <br />voting machines. Therefore, and in consideration of the mutual covenants and <br />premises stated herein, the parties agree that: <br /> <br />1. Lease and Term NORDICK shall lease the PROPERTY to TENANT, and <br />TENANT may occupy the PROPERTY for a term commencing November 1, 2005, and <br />expiring October 31, 2010, unless sooner terminated as hereinafter provided. <br /> <br />2. Rent Payment TENANT shall pay to NORDICK monthly rent of $1 ,300.00 <br />in advance on the 1 st day of each month commencing November 1, 2005 and <br />continuing until the expiration or earlier termination of the lease. <br /> <br />3. Real Estate Taxes and Casualty Insurance NORDICK shall pay all real <br />estate taxes assessed against the value of the real estate. NORDICK shall pay the <br />cost of property damage insurance for the real estate. <br /> <br />4. Lawn Care and Snow Removal NORDICK shall furnish and pay the full <br />cost of all common area maintenance, including care of the lawns, landscaping and <br />parking areas. <br /> <br />5. Liability Insurance TENANT shall obtain and keep in force during the <br />term of this lease a liability insurance policy insuring NORDICK as an additional named <br />insured against any liability arising out of the use, occupancy or maintenance of the <br />PROPERTY. Such insurance shall be in an amount not less than $1,000,000 per <br />occurrence. The policy shall also insure performance by TENANT of the indemnity <br />provisions of paragraph 7. The limits of said insurance shall not, however, limit the <br />liability of TENANT thereunder. <br />
