<br />CASS COUNTY <br />COMMISSION POLICY MANUAL <br /> <br />38.17 <br /> <br />SUBJECT: ORDINANCE #2005-5 (ALCOHOLIC BEVERAGE SALE AND CONSUMPTION) <br /> <br />ADOPTED DATE: <br /> <br />Page 1 of 1 <br /> <br />CASSCOUNTYGOVERNMENT <br />ORDINANCE #2005-5 <br /> <br />AN ORDINANCE TO EXTEND THE POSSIBLE CLOSING TIME FOR ALCOHOLIC <br />BEVERAGE SALE AND CONSUMPTION WITHIN CASS COUNTY <br /> <br />WHEREAS, N.D.C.C. 95-02-01 requires any person engaging in the retail sale of alcoholic <br />beverages to secure an appropriate license from the Attorney General and a <br />local license from the local governing body; and <br /> <br />WHEREAS, N.D.C.C. 95-02-09 provides that the local governing body may by ordinance or <br />resolution regulate or restrict the operation of licensees including, among other <br />things, the setting of hours; and <br /> <br />WHEREAS, In the 2005 legislative session, the North Dakota Legislature modified N.D.C.C. <br />95-02-05 to, among other things, extend the possible closing time from 1 :00 a.m. <br />until 2:00 a.m. <br /> <br />NOW, THEREFORE, Be it resolved by the Cass County Board of Commissioners that those <br />licensees engaged in the retail sale of alcoholic beverages and subject to the requirements of <br />N.D.C.C.
