p America Vote Act~ <br />Senate Bill 2409 allows the Secretary of State's office and county election officials to <br />plan and take immediate steps to comply with HAVA requirements. Impacting several <br />areas of North Dakota's election laws and phasing in HAVA implementation over the <br />course of the next several years, the legislation adds the following initiatives to state law: <br /> Establishes by law the state's Election Fund for depositing payments and grants <br /> made to the state and funds appropriated by the state to carry out HAVA. The <br /> Election Fund shall be used for the exclusive purpose of carrying out activities of <br /> HAVA. <br /> · Requires and authorizes the Secretary of State to establish a state-based <br /> grievance procedure to handle complaints of violations under Title III of HAVA. <br /> · Requires additional information to be posted at the polling place on Election Day <br /> in accordance with HAVA. <br /> · Requires and authorizes the Secretary of State to adopt rules for the purpose of <br /> certifying and decertifying electronic voting systems and electronic counting <br /> machines to ensure compliance with federal standards and to establish <br /> guidelines for determining what constitutes a vote on each electronic voting <br /> system authorized to be procured and used in the state. <br /> · Eliminates all references to voting machines (lever machines) and punch card <br /> electronic voting systems and counting machines and punch card supplies. <br /> · Authorizes the use of direct recording electronic voting systems, more commonly <br /> referred to as DREs (including touch screen voting devices) that are intended to <br /> accommodate the disability requirements contained in Title III of HAVA. <br /> · Clarifies and expands the duties of the Secretary of State as they relate to the <br /> administration of elections and the implementation of changes necessary to <br /> comply with HAVA. <br /> · Authorizes the Secretary of State to promulgate administrative rules for <br /> implementing the provisions of Title 16.1 and any other requirement imposed <br /> upon the state by HAVA. <br /> · Changes the number of voting booths or compartments and electronic voting <br /> system devices required in each precinct. <br /> · Requires voters who cast ballots as a result of a polling place remaining open <br /> after normal voting hours by court order to cast provisional ballots in accordance <br /> with HAVA. Provisional ballots cast according to this provision must be <br /> segregated from other votes cast. <br /> <br />· REQUIRED DESCRIPTIONS [Sec 254, H~4 V~4 2002] <br /> <br />ao <br /> <br />Voting System Standards <br />Revised state law authorizes the use of voting systems within North Dakota that <br />will comply with both second chance voting and disability access requirements, <br />as required by HAVA.
