<br />WHEREAS, Developer agrees to construct all roads and drainage improvements <br /> <br />within said subdivision in accordance with conditions of approval granted by the County. <br /> <br />WHEREAS, Developer agrees to construct all other improvements within said <br /> <br />subdivision in accordance with conditions of approval granted by the County. <br /> <br />WHEREAS, said road, drainage, and all other required improvements shall not be <br /> <br />considered to bc so constructed until the County of Cass Engineer ccrtifies the same to be <br /> <br />true. <br /> <br />WHEREAS, the Developer agrees said subdivision shall not be allowed to be <br /> <br />recorded and lots sold until all required improvements are constructed and the County of <br /> <br />Cass Engineer certifies the same to be truc. <br /> <br />WHEREAS, the Developer agrees that if all improvements of said subdivision <br /> <br />have not constructed and certified by the County of Cass Engineer to be true by <br /> <br />November I, 2006 or by the date established by the approved time extension, that the <br /> <br />conditional approval granted by the County of said subdivision shall be null and void. <br /> <br /> <br />WHEREAS, the Developer agrees that if the conditional approval granted by the <br /> <br /> <br />County of said subdivision is {()Und to be null and void that the Developer will construct <br /> <br /> <br />a permanent tumaround at the edge ofthe Bison View Estates I, consisting of a cul-de- <br /> <br />sac with a minimum sur/ace radius of sixty (60) feet and a minimum right-of-way radius <br /> <br />of seventy (70) feet. The surface of the turnmound shall consist of six (6) inches of Class <br /> <br />V gravel and have a clay subgrade. The ditches along the cul-de-sac shall be constructed <br /> <br />with a minimum ditch grade of not less than one-tenth of one percent (0.01%) ~md <br /> <br />inslopes shall be a minimum of 5: I slope to rise ratio. <br />
