<br />DEVELOPERS AGREEMENT <br /> <br />Agreement made this the _ day of~200_, by and between the COUNTY <br /> <br />OF CASS, a political subdivision having its territorial limits within the State of North <br /> <br />Dakota ("County"), and Lyle Andvik ("Developer"). <br /> <br />WITNESSETH: <br /> <br />That we, duly authorized to act on behalf of the Developer are bound unto the <br /> <br />County in the sum affor all associated costs for installation of a permanent cul-de-sac for <br /> <br />which payment, well and tmly to be made, we bind ourselves, heirs, successors and <br /> <br />assigns firmly by these presents. <br /> <br />Signed sealed and delivered this __..day of__200_____. <br />THE CONDITION OF THE OBLIGA nON IS SUCH THAT: <br />WHEREAS, Developer desires to subdivide, develop and improve a track of land <br />located on the Southwest Quatter of Section 33, Township 137 North and Range 51 <br />West, in Davenport Township, County of Cass, and State of North Dakota more <br />particularly shown on that certain subdivision plat entitled Bison View Estates II, which <br />plat will be filed with the County of Cass Recorder of the County of Cass Recorders <br />Office. <br /> <br />WHEREAS, the County has approved said plat on condition that said Developer, <br /> <br /> <br />its duly authorized agent(s) or its assignee(s) will complete all requirements established <br /> <br /> <br />with the approval granted by the County at a date not to exceed November 1,2006, <br /> <br /> <br />unless the County grants a time extension. <br />
