16. <br /> <br />17. <br /> <br />Commission Minutes--April 7, 2003 2577 <br /> <br />LEASE OF FLOOD BUY-OUT LAND, 4-H Outdoor Skills Pro~ram <br />Brad Cogdill, NDSU/Cass County Extension Service, was present representing the 4-H <br />Outdoor Skills Program request to lease a parcel of land in Section 4, Addison Township. <br />Cass County acquired this land through the flood buy-out program. Also present was Robert <br />Stalloch, 4-H volunteer leader, who works with youth participating in outdoor activities and <br />teaches skills in handling various guns and archery. He said the property meets minimum <br />safety requirements for a shooting park, and he currently serves 5-12 youth in the program. <br /> <br />In a letter to County Auditor Michael Montplaisir dated March 12, 2003, Maxine Nordick, 4-H <br />Youth Extension Agent, indicated the program instructors will be responsible for maintaining <br />the property. The North Dakota 4-H Shooting Sports program follows risk management <br />practices such as liability protection for volunteers under North Dakota law, informed consent <br />forms, youth protection policy, waiver of liability indemnification and medical release. <br /> <br />Mr. Montplaisir said the county has a standard lease agreement for flood lots, and the term <br />of the lease is normally for one year. He had a question on the insurance, and State's <br />Attorney Birch Burdick said he will work with Mr. Cogdill to draft an amendment to the lease <br />agreement to address the liability issues to everyone's satisfaction. <br /> <br />Mr. Vanyo noted the term of the proposed lease is for one year, with terms and conditions <br />renewing automatically for an additional thirty-six month period, unless either party serves <br />written notice of non-renewal within 60 days prior to the lease expiration date. While he <br />supports the program, Mr. Vanyo stated his concerns on the length of the lease considering <br />the number of people it serves. Mr. Stalloch said he would be agreeable to a one-year <br />renewal and suggested a 30-day termination notice by either party. Mr. Cogdill said the <br />program is fairly new, and he expects it to be one of the growth areas in the 4-H program. <br /> MOTION, passed <br /> Mr. Bennett moved and Mrs. Sorum seconded to approve the request, <br /> subject to revisions by the State's Attorney, and authorize the chairman to <br /> sign a lease agreement with 30 days termination notice from both sides <br /> for a parcel of land (parcel #21-0000-00015-020) with the Cass County 4-H <br /> Outdoor Skills Program. The land will be used as a site for instruction and <br /> training in disciplines offered by the program. On roll call vote, the motion <br /> carried unanimously. <br /> <br />ROAD DEPARTMENT, Purchase order for telephone equipment/service <br />Keith Berndt, County Engineer, was present with a request to upgrade the telephone <br />equipment and service at the Highway Department at a cost of $52,000, which would be paid <br />from the county's telephone trust fund. He said the new system would provide better <br />customer service and would increase efficiency for the department. Mr. Montplaisir said this <br />change is possible because of a new fiber line, and the Highway Department will pay the <br />same rate per telephone as all county offices pay into the telephone trust fund. MOTION, passed <br /> Mr. Meyer moved and Mr. Vanyo seconded to authorize the chairman to <br /> sign a purchase order for the new telephone system for the Highway <br /> Department and to make the necessary budget adjustments. On roll call <br /> vote, the motion carried unanimously. <br /> <br /> <br />
