19. The Coordinator shall not be liable or use its funds for the payment of benefits under the <br /> Plan. The Coordinator does not insure or underwrite the Employer's liability to provide <br /> benefits under the Plan, and the Employer shall have the final responsibility and liability for <br /> payment of benefits under the Plan. <br /> <br /> Section II - Cost of Administration <br /> <br /> The Coordinator shall be entitled to a fee for its services to the Plan and under this <br />Agreement, which shall be payable in accordance with the following fee schedule: <br /> <br />$0.00 Annual fee. <br /> <br />$5.00 per month per spending account participant. <br /> <br />N/A Optional Service Requested: <br /> <br />N/A Optional Service Requested: <br /> <br />N/A Optional Service Requested: <br /> <br /> The annual fee will be paid at the adoption of this Agreement and upon renewal thereafter. <br />Monthly fees will be invoiced monthly and are due within 30 days after invoice. <br /> <br /> The Coordinator shall retain all interest income earned on the contributions received by it <br />from the Employer in accordance with the Trust Agreement. Said interest income will not be <br />deemed a payment of any part of the fees due to the Coordinator per the terms of this <br />Agreement. <br /> <br /> Section III - The Employer <br /> <br /> Responsibilities of the Employer in the administration of the Plan shall include the <br />following: <br /> <br />1. The Employer shall provide the Coordinator with a complete list of all employees eligible to <br /> participate in the Plan. Thereafter, the Employer shall notify the Coordinator on a monthly <br /> basis of all changes in participation. <br /> <br /> The Employer shall collect the contributions, if any, made by the employees to the Plan in <br /> the manner it may deem appropriate. The Employer, upon notice from the Coordinator, shall <br /> remit any amounts necessary to pay Plan benefits or other Plan expenses. <br /> <br />3. The Employer shall assist in the enrollment of the employees in the Plan, cooperate with the <br /> Coordinator with regard to proper settlement of the claims and transmit any inquiries <br /> pertaining to the Plan to the Coordinator.
