o Delegation of medication administration in acute care settings or for
individuals with unstable or changing nursing care needs is
specifically precluded by these rules.

The Board of Nursing recognizes that expanded technology and innovative
healthcare models require ongoing adjustments in the delivery of nursing care in all
settings. The Board recognizes that the range of health care services available in North
Dakota is very diverse in breadth and depth, and available nursing services are extremely
varied. However, the North Dakota citizen has the right to expect that nursing care
rendered to their family is based upon appropriate knowledge, skills and abilities of the
licensed nurse and their assistant regardless of the location of the individual.
Individual licensed nurses are accountable for their actions including the
performance of or supervision of the performance of activities and functions requiring the
knowledge, skills and abilities currently ascribed to the licensed nurse. The Board of
Nursing will continue to judge nursing practice according to the provisions of the Nurse
Practices Act, the legal standards of nursing as promulgated through the Administrative
Rules of the Board of nursing, and collective wisdom of the appointed board members.
Again, we are pleased to support the effort of your organization and the delivery
of medication safely to the population at the Burleigh County Jail. There is no question
that setting a high standard for safe and best practices will be beneficial for every region
of North Dakota.

Sincerely,
(J~tre-U i&l::Z~~

Constance B.
