2 <br />WHEREAS, to facilitate the design, construction, management, and financing of the <br />DCAI, the Metro Flood Diversion Authority approved on September 2, 2015, a Notice of Intent <br />to development a P3 pursuant to North Dakota Century Code Chapter 48-02.1; and <br /> <br />WHEREAS, North Dakota Century Code Chapter 48-02.1 gives the Metro Flood <br />Diversion Authority broad discretion to enter into a P3; and <br /> <br />WHEREAS, on July 14, 2016, the Metro Flood Diversion Authority, with concurrence <br />from the Cass County Joint Water Resource District, adopted a resolution establishing the procedures and protocols for the Request for Qualifications (“RFQ”) phase of the P3 <br />procurement and issuing the RFQ to design, build, finance, operate, and maintain the DCAI (the <br />“Resolution”); and <br /> <br />WHEREAS, the Evaluation Team, pursuant to the terms of the Resolution, formulated Evaluation Criteria against which SOQs would be evaluated, including organization and <br />management, technical experience, technical capability, safety, project understanding, financial <br />experience, and financial capacity, and a scoring matrix; and <br /> <br />WHEREAS, on or about September 14, 2016, the Metro Flood Diversion Authority received six (6) Statements of Qualifications (“SOQs”) in response to the RFQ; and <br /> <br />WHEREAS, those Respondents submitting an SOQ in response to the RFQ included <br />Lake Agassiz Partners, Red River Alliance, Red River Infrastructure Solutions, Red River <br />Partners, Red River Valley Alliance, and Red River Valley Partners; and <br />WHEREAS, the Evaluation Team reviewed the SOQs and conducted interviews of the <br />Respondents; and <br /> <br />WHEREAS, based upon the information provided in the SOQs and during the interviews, the Evaluation Team assessed scores for each SOQ for each Evaluation Criteria and <br />created a report outlining its evaluation process and assessment (the “Report”); and <br /> <br />WHEREAS, the Evaluation Team, based upon their assessment, made a <br />recommendation in the Report to short list four (4) Respondents, including Lake Agassiz Partners, Red River Partners, Red River Valley Alliance, and Red River Valley Partners; and <br /> <br />WHEREAS, the Evaluation Team submitted the Report, along with its short listing <br />recommendation, and an executive summary of each Respondent to the Co-Executive Directors <br />for their review; and <br />WHEREAS, after review of the report, the Co-Executive Directors joined in the <br />recommendation to short list four (4) Respondents, including Lake Agassiz Partners, Red River <br />Partners, Red River Valley Alliance, and Red River Valley Partners; and <br /> <br />WHEREAS, the Metro Flood Diversion Authority has had the opportunity to review the <br />Report, along with the joint short listing recommendation of the Evaluation Team and the Co- <br />Executive Directors, and an executive summary of each Respondent; and <br />
