3 <br />ARTICLE II. DRAFTING <br /> Section 2.01 RFQ DRAFT PREPARATION. The Drafters of the RFQ will consist of a diversified group of individuals representing the Metro Flood Diversion Authority, who possess financial, legal, project management, and engineering backgrounds. During the drafting phase of <br />the RFQ, Drafters may solicit, in their sole discretion, information and assistance from other <br />disciplines and outside consultants or advisors. Drafters of the RFQ will include engineering, <br />legal, financial, risk management, and project management professionals. The Drafters have full discretion to include, in addition to the specific provisions provided in this Procedure, other provisions which are believed to be appropriate to include in the RFQ. <br /> <br /> Section 2.02 FINAL DRAFT. The Final Draft of the RFQ must be clearly marked as final and will be transmitted to the Executive Director for dissemination to and review by the Metro Flood Diversion Authority, the Diversion Authority Board, and the Member Entities. <br /> <br />ARTICLE III. ADOPTION <br />Section 3.01 REVIEW AND RESOLUTION. The Metro Flood Diversion Authority will <br />review the RFQ following receipt and review of the Final Draft to determine whether to adopt <br />the Resolution. Voting by the Diversion Authority Board on the Resolution will occur in accordance with Article V of the Joint Powers Agreement. <br /> <br />Section 3.02 CCJWRD ADOPTION. The Metro Flood Diversion Authority’s adoption <br />of the Resolution is contingent upon a resolution by the CCJWRD authorizing issuance of the <br />RFQ. Accordingly, the Metro Flood Diversion Authority will not adopt the Resolution until after the CCJWRD has adopted a separate resolution authorizing issuance of the RFQ. <br /> <br />ARTICLE IV. POSTING AND PUBLICATION <br />Section 4.01 POSTING AND PUBLICATION. Following adoption of the Resolution, the <br />Metro Flood Diversion Authority will post the RFQ on its website, www.fmdiversion.com, and will also publish official notice that the RFQ is available in the The Forum (the official newspaper of the Diversion Authority) and in a trade publication, electronic plan service, <br />builders exchange, or other industry recognized method of general circulation among contractors <br />within both the State of North Dakota and the United States, once each week for three (3) <br />consecutive weeks, with the first publication being at least twenty-one (21) days before date upon which SOQs are required to be submitted. <br />ARTICLE V. <br />EVALUATION TEAM <br /> Section 5.01 DUTIES AND RESPONSIBILITIES.
