<br />This is Task Order No.6, Amendment 43, <br />consisting of 6 pages. Task Order No. 6, Amendment 43 <br />In accordance with Paragraph 1.01 of the Agreement Between Fargo-Moorhead Flood Diversion Authority <br />(“Owner”) and Houston-Moore Group, LLC (HMG) (“Engineer”) for Professional Services – Task Order Edition, <br />dated March 8, 2012 ("Agreement"), Owner and Engineer agree as follows: <br />The parties agree that in the event of a conflict between prior versions of this Task Order No. 6 and this <br />Amendment, the terms and conditions in this Amendment shall prevail, provided however, nothing herein shall <br />preclude ENGINEER from invoicing for work authorized under prior versions of this Task Order and performed prior <br />to effective date of this Amendment, even to the extent such prior work was revised by this Amendment. All other <br />terms and conditions shall remain the same and are hereby ratified and affirmed by the parties. <br /> <br />1. Specific Project Data <br />A. Title: Land Management Services <br />B. Description: Perform land management services as requested during the pre- and early- <br />acquisition period of the Diversion Project. Services are generally related to determination of <br />design information, outreach communication with land owners affected by the project, and <br />appraisals of properties requesting hardship purchase. Prepare and update the opinion of cost <br />for the purchase of anticipated real property and easements for properties within proposed <br />project. <br />i. Prior to Amendment 4 of this Task Order, work under subtask 2.H (Draft Real Estate <br />Opinion of Cost) was completed for the whole project, and work under subtasks 2.A <br />through 2.G was previously done for the whole project (North Dakota and Minnesota). <br />For Amendment 4 of this Task Order, as listed in the scope below, the Engineer will <br />generally provde land management services in Minnesota for the Diversion Project. <br />B.C. Background: The Owner selected three (3) firms to perform land acquisition services at the Board <br />meeting on February 9, 2012. During the design phase of the project, and prior to execution of <br />the Project Partnership Agreement, the services will generally be related to acquiring Right-of- <br />Entry authorization for determination of information required for design documents, <br />communications with land owners within the project boundaries, communication with the <br />United States Army Corps of Engineers (USACE) Real Estate staff, preparation of appraisals for <br />specific parcels, and early acquisition of properties. <br />i. The Owner has assigned Cass County Joint Water Resource District (CCJWRD) to manage <br />the negotiated acquisition of property in North Dakota for the Diversion Project, and the <br />North Dakota land acquisition services of the three (3) selected firms are now <br />contracted with the CCJWRD. For Amendment 4 of this Task Order, as listed in the scope <br />below, the Engineer will generally provde land management services in Minnesota for <br />the Diversion Project. <br />2. Services of Engineer <br />A. Perform Right-of-Entry services as requested for FY-13. Activities include: <br />i. Maintain the existing GIS database of parcels originally prepared by the USACE. Develop <br />and maintain an interactive web-based GIS database showing right-of-entry status of <br />parcels. <br />ii.
