Mr. Wieland stated that the hearing for Judge Donald Cooke before <br />the North Dakota Judicial Conduct Commission has been delayed until <br />December 22, 1987, and it is not known when a decision will be made. <br />Mr. Hoy felt that the appointment of a temporary judge, if approved <br />by Presiding Judge Norman J. Backes, could be renewed for 30 days <br />if necessary. <br />Mr. Larson moved and Mrs. Stanton seconded that Cass County join <br />County Judge Cynthia Rothe in petitioning Presiding Judge Norman J. <br />Backes for appointment of a temporary judge for Cass County Court <br />pursuant to North Dakota Supreme Court Administrative Rule 8, Section <br />2, for an initial period of 30 days. On roll call vote, the motion <br />carried unanimously. <br />Diana Murack presented a bill from the City of Fargo requesting <br />the County's portion of the air transportation expenses which were <br />incurred for the proposed joint Law Enforcement Center. Mr. Eckert <br />moved and Mr. Sondrall seconded to pay the County's 2/3 share, in <br />the amount of $533.33, as outlined by the Administrative Assistant. <br />On roll call vote, the motion carried unanimously. <br />Diana Murack reported that the application deadline for the <br />position of personnel technician has passed, and an initial review <br />of the 31 applications has been made. <br />Concerning a request last week from Cargill, Inc. for moving <br />an anhydrous ammonia plant near Amenia, States Attorney Robert Hoy <br />stated that the statutes provide that whenever there is an anhydrous <br />facility constructed, the applicant must obtain permission from the <br />County Commission and then obtain a license from the State Department <br />of Agriculture. He recommended that the County notify the governing <br />bodies of Amenia Township and the City of Amenia after receiving <br />Cargill's application, and invite their input. He also recommended <br />asking the Sheriff or the Disaster Emergency Manager to examine the <br />site and determine that it meets siting requirements. Mr. Eckert <br />stated that there is a meeting scheduled with Cargill and residents <br />of Amenia, and Mr. Hoy felt the Commission would be interested in <br />the outcome of that meeting. Several County officials plan to attend. <br />The States Attorney found no requirement for publishing a notice <br />of hearing, and the hearing date tentatively set for December 8th <br />no longer applies until the County receives a formal application from <br />Cargill. <br />Mrs. Stanton moved and Mr. Larson seconded that Chairman be <br />authorized to sign the County Deeds for five parcels of land sold <br />by the County Auditor at the annual tax sale held on November 17, <br />1987. On roll call vote, the motion carried unanimously. <br />Mr. Larson moved and Mr. Eckert seconded to authorize the County <br />Auditor to cancel the general taxes in the amount of $409.61 and to <br />cancel the special assessments in the amount of $911.87 on the above <br />five parcels of land sold at the annual tax sale. On roll call vote, <br />the motion carried unanimously. <br />
