PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br />Mr. Richards informed the Commission that the County Road Department will be closed on Friday after <br />Thanksgiving with the employees taking it as a vacation day. <br />Mr. Sondrall moved and Mr. Eckert seconded to authorize Don Richards and States Attorney Robert Hoy <br />to determine the method of proceeding with the disposal of four motor graders, and to proceed with the <br />sale accordingly. Motion carried. <br />Mr. Wieland reported that Frank Richard, County Surveyor, passed away last Saturday after receiving <br />severe injuries in an automobile accident. A letter of sympathy will be sent to his family. On roll call vote, the motion carried unanimously. <br />Mrs. Stanton moved and Mr. Eckert seconded to renew the current public defender contracts for <br />calendar year 1988 at an annual salary of $17,100.00, which represents an increase from $1,375 to $1,425 <br />per month. On roll call vote, the motion carried unanimously. <br />Regarding the public defender mental health contract with the Ottmar Law Firm at Jamestown, <br />Mrs. Stanton suggested asking Judge Cynthia Rothe to propose a salary figure for 1988. The Chairman <br />asked Administrative Assistant Diana Murack to contact Judge Rothe and obtain a suggested figure for <br />consideration next week. <br />County Auditor Ordelle Brua held a bid opening in her office at 10:00 A.M. for the sale of NCR <br />computer equipment. One bid was received for $1,200.00. Mrs. Stanton moved and Mr. Eckert seconded that <br />Richard Offutt, Director of Administrative Services, be authorized to review the bid and make a <br />recommendation next week. Motion carried. <br />A letter was read from County Judge Cynthia Rothe, dated November <br />appointment of a temporary judge for Cass County Court. She stated in the <br />Donald Cooke's most recent absence, the caseload has become unmanageable for <br />asked how this would differ from what is presently being done in County Court <br />Hoy stated that the current situation is that Judge Mikal Simonson from Barnes <br />in Cass County Court as a courtesy, when his schedule permits. <br />Mr. Wieland stated that the hearing for Judge Donald Cooke before the North Dakota Judicial Conduct <br />Commission has been delayed until December 22, 1987, and it is not known when a decision will be made. <br />Mr. Hoy felt that the appointment of a temporary judge, if approved by Presiding Judge Norman J. Backes, <br />could be renewed for 30 days if necessary. <br />Mr. Larson moved and Mrs. Stanton seconded that Cass County join County Judge Cynthia Rothe in <br />petitioning Presiding Judge Norman J. Backes for appointment of a temporary judge for Cass County Court <br />pursuant to North Dakota Supreme Court Administrative Rule 8, Section 2, for an initial period of 30 <br />days. On roll call vote, the motion carried unanimously. <br />Diana Murack presented a bill from the City of Fargo requesting the County's portion of the air <br />transportation expenses which were incurred for the proposed joint Law Enforcement Center. Mr. Eckert <br />moved and Mr. Sondrall seconded to pay the County's 2/3 share, in the amount of $533.33, as outlined by <br />the Administrative Assistant. On roll call vote, the motion carried unanimously. <br />Diana Murack reported that the application deadline for the position of personnel technician has <br />passed, and an initial review of the 31 applications has been made. <br />Concerning a request last week from Cargill, Inc. for moving an anhydrous ammonia plant near Amenia, <br />States Attorney Robert Hoy stated that the statutes provide that whenever there is an anhydrous facility <br />constructed, the applicant must obtain permission from the County Commission and then obtain a license <br />from the State Department of Agriculture. He recommended that the County notify the governing bodies of <br />Amenia Township and the City of Amenia after receiving Cargill's application, and invite their input. He <br />also recommended asking the Sheriff or the Disaster Emergency Manager to examine the site and determine <br />that it meets siting requirements. Mr. Eckert stated that there is a meeting scheduled with Cargill and <br />residents of Amenia, and Mr. Hoy felt the Commission would be interested in the outcome of that meeting. <br />Several County officials plan to attend. The States Attorney found no requirement for publishing a <br />notice of hearing, and the hearing date tentatively set for December 8th no longer applies until the <br />County receives a formal application from Cargill. <br />20, 1987, regarding the <br />letter that during Judge <br />one judge.
