<br />PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS
<br />OF CASS COUNTY, NORTH DAKOTA
<br />Don Eckert reported that the County Planning Commission held a special meeting on August 25th, and
<br />they recommended retaining member Fred Selberg because he represents the County Planning Commission on
<br />the F -M Metropolitan Council of Governments. Also at their special meeting, the County Planning
<br />Commission suggested that the County Commission consider appointing those persons resigning to an
<br />advisory board and possibly paying their mileage to attend meetings. Mr. Eckert stated that both Dayton
<br />Byram and Joseph Moore would be willing to act as advisors. Mr. Moore had questioned the need to submit
<br />a letter of resignation since he was not a legal member of the Planning Commission, but Mr. Wieland felt
<br />we should have a written resignation.
<br />Mrs. Stanton moved and Mr. Larson seconded to accept the resignation of Cass County Planning
<br />Commissioner Dayton Byram with regrets, effective August 25, 1986. Motion carried.
<br />Mr. Eckert moved and Mrs. Stanton seconded to appoint an advisory board to the County Planning
<br />Commission consisting of no more than three people, and that Dayton Byram be appointed to this committee.
<br />On roll call vote, the motion carried unanimously.
<br />Mrs. Stanton moved and Mr. Larson seconded that the Chairman be authorized to send a letter to
<br />Richard Rayl, Director of the Office of Management and Budget, to Governor George Sinner, to Lt. Governor
<br />Ruth Meiers and to Congressmen Dorgan, Andrews and Burdick stating the Cass County Commission's views on
<br />the Community Development Block Grant program. Motion carried.
<br />On motion by Mr. Larson and seconded by Mrs. Stanton, the meeting was adjourned.

<br />REGULAR MEETING OF CASS COUNTY COMMISSIONERS
<br />SEPTEMBER 2, 1986
<br />Chairman Alon Wieland called the meeting to order with all members present as follows: Jeannette
<br />Stanton, Don Eckert, Alon Wieland, Oscar Sondrall and Ray Larson.
<br />Mrs. Stanton moved and Mr. Eckert seconded that the minutes of the previous meeting be approved as
<br />written. Motion carried.
<br />Discussion was held with States Attorney Robert Hoy on- renewal of professional liability insurance
<br />through the National District Attorney's Association Policy. The premium has increased from $1,750.00 to
<br />$3,120.00 with a $1,250.00 deductible per claim. Mr. Hoy recommended that the insurance coverage be
<br />continued for special risks encountered by the County through its attorneys. Mrs. Stanton asked if the
<br />States Attorneys are not covered under the County's general liability, and Mr. Hoy stated that he does
<br />not believe so and he believes the present policy cannot be amended to include this coverage. Last year
<br />he contacted Insurance Consultant Robert Rust, who indicated in a letter that he felt it was a good
<br />policy and could not be obtained elsewhere. The Commission asked Mr. Hoy to provide copies of that
<br />letter for the next Commission meeting.
<br />County Engineer Don Richards stated that he is also concerned about professional liability
<br />insurance. The Commission requested Scott Krueger, Administrative Assistant, to contact the National
<br />Association of Counties regarding all professional liability insurance on the County level.
<br />An Attorney from the Nilles Law Firm of Fargo and Attorney James Winn of the Stinson, Mag Fizzell
<br />Law Firm of Kansas City, MO, were present for a public hearing which was held at 9:30 A.M. representing
<br />Riverview Place, Inc. on reapproval of MIDA Bonds for an. elderly housing development located at the.
<br />former Sacred Heart Convent property south of Fargo. The Chairman asked if anyone wished to address the
<br />issue at the public hearing, but there were no comments from any member of the public. Mrs. Stanton
<br />moved and Mr. Larson seconded to adopt the RESOLUTION AUTHORIZING CASS COUNTY, NORTH DAKOTA, TO ISSUE ITS
<br />CATHOLIC HEALTH CORPORATION SEMIANNUAL TENDER REVENUE BONDS (RIVERVIEW PLACE, INC. PROJECT), SERIES 1986,
<br />IN THE AGGREGATE PRINCIPAL AMOUNT OF $10,000,000, FOR THE PURPOSE OF FINANCING THE COST OF ACQUIRING,
<br />CONSTRUCTING, RECONSTRUCTING AND EQUIPPING A RETIREMENT HOUSING FACILITY FOR THE ELDERLY, AND APPROVING
<br />CERTAIN OTHER MATTERS RELATED THERETO. The Chairman indicated that he will be reviewing it with the
<br />States Attorney prior to signing the resolution. On roll call vote, the motion carried unanimously.
<br />Mr. Mick Pflugrath, President of the Fargo -Cass County Industrial Development Corporation, was
<br />present along with other Board members, to request that Cass County allocate $100,000.00 from the 1987
<br />County Budget to be used for advertising and to promote development in this area. He stated that the
<br />economy has lured businesses to other areas and other states. Mr. Larson moved and Mrs. Stanton seconded
<br />to receive the 1987 budget request and discuss it further at budget meetings. Motion carried.
