Department for a portion of old Highway 10 near Casselton at the <br />intersection of County Road 18 which the County received from the <br />State Highway Department by Quit Claim Deed dated November 5, 1973. <br />On roll call vote, the motion carried unanimously. <br />Mr. Eckert moved and Mr. Wieland seconded that the County Road <br />Department be authorized to change to the time -of -use option for <br />electrical energy control. On roll call vote, the motion carried <br />unanimously. The Chairman suggested that Commissioner Eckert work <br />with the Sheriff to see if the same option can be exercised at the <br />Juvenile Justice Center. <br />Mr. Eckert moved and Mr. Sondrall seconded to approve partial <br />payments to T.F. Powers Construction in the amount of $1,805.00, to <br />Dakota Electric Construction in the amount of $630.00 and to West <br />Fargo Plumbing and Heating in the amount of $3,800.00 to be paid from <br />the Extra Ordinary Outlay Fund. On roll call vote, the motion carried <br />unanimously. <br />Mrs. Stanton moved and Mr. Sondrall seconded to receive and file <br />the Indemnity Bond on Lost Instrument for Beverly Thompson, and <br />authorize the County Auditor to issue a duplicate check. On roll <br />call vote, the motion carried unanimously. <br />Ordelle Brua, County Auditor, informed the Board that the present <br />Public Defender contracts expire December 31, 1985. Mrs. Stanton <br />moved and Mr. Eckert seconded to advertise for proposals for indigent <br />defense services for Cass County Court at the same amount as last <br />year. On roll call vote, the motion carried unanimously. <br />The County Auditor reported that the request she made last for <br />the Commission to cancel the 1985 taxes on property sold at the annual <br />tax sale on November 19, 1985, is a requirement of the North Dakota <br />Century Code. Mr. Eckert moved and Mr. Sondrall seconded to cancel <br />the 1985 taxes as requested by the County Auditor. The motion carried <br />on roll call vote with four members voting "Aye" and Mr. Wieland voting <br />"Pass" because he questioned why the Commission needs to pass a motion <br />when it is requirement of the North Dakota Century Code. <br />Mr. Wieland stated that the State Highway Department has agreed <br />that a traffic signal light can be installed on Tenth Street at 2nd <br />Avenue South, but the State Highway Department would not participate <br />in the cost, which is estimated at $50,000 $70,000. The Chairman <br />requested Scott Krueger to investigate other options such as a tunnel <br />under Tenth Street or a skyway. <br />Mr. Eckert moved and Mr. Sondrall seconded that the Chairman <br />and the Auditor be authorized to sign the plat of First Replat of <br />Part of Springvale Cemetery for the purpose of having it recorded <br />by the Register of Deeds. On roll call vote, the motion carried <br />unanimously. <br />The Commissioners received copies of the Court Management <br />Consultants study of the court facilities. <br />
