PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br />Attorney Karen Klein presented proposed resolutions for the Riverdale Subdivision, Chrisan and <br />Chrisan 2nd Subdivisions Street Improvement Projects. A public hearing was set for 10:00 A.M., and the <br />Chairman asked if anyone wished to protest the assessments. Hearing none, Mr. Sondrall moved and <br />Mrs. Stanton seconded to adopt the RESOLUTION CONFIRMING ASSESSMENT LIST IN STREET IMPROVEMENT DISTRICT <br />1984 -2 (Chrisan and Chrisan Second Subdivisions). On roll call vote, the motion carried unanimously. <br />Hearing no protests, Mrs. Stanton moved and Mr. Sondrall seconded to adopt the RESOLUTION <br />CONFIRMING ASSESSMENT LIST IN STREET IMPROVEMENT DISTRICT 1984 -1 (Riverdale Subdivision). On roll call <br />vote, the motion carried unanimously. <br />Scott Krueger, Administrative Assistant, reported that the Cass County Building Authority met this <br />morning. Mrs. Stanton moved and Mr. Eckert seconded that Ordelle Brua, Cass County Auditor, be approved <br />as a Director of the Cass County Building Authority. On roll call vote, the motion carried unanimously. <br />Mrs. Stanton moved and Mr. Eckert seconded to adopt the following RESOLUTION APPROVING DOCUMENTS <br />AND INITIAL RESOLUTION OF CASS COUNTY BUILDING AUTHORITY RE: $3,775,000 CASS COUNTY BUILDING AUTHORITY <br />FIRST MORTGAGE REVENUE BONDS SERIES 1985: On roll call vote, the motion carried unanimously. <br />WHEREAS, the Board of County Commissioners of the County of Cass, North Dakota, has previously <br />passed a resolution approving the Cass County- Building Authority, a North Dakota non profit corporation, <br />and approving its directors; and <br />WHEREAS, the Cass County Building Authority has passed an initial resolution concerning the <br />$3,775,000 Cass County Building Authority First Mortgage Revenue Bonds Series 1985; and <br />WHEREAS, the Board of County Commissioners has reviewed the form of the Ground Lease, Lease, and <br />Mortgage and Indenture of Trust; <br />NOW THEREFORE BE IT RESOLVED, that the Board of County Commissioners approves the form of the <br />Ground Lease, Lease, and Mortgage and Indenture of Trust attached to this resolution. <br />BE IT FURTHER RESOLVED, that the Board of County Commissioners approves the initial resolution of <br />the Cass County Building Authority authorizing Ehler Associates, Inc. to procure bids for the sale of <br />the Bonds to be issued by the Cass County Building Authority. <br />BE IT FURTHER RESOLVED, that the Board of County Commissioners will meet on April 2, 1985 to review <br />the bids and to determine whether or not to approve and consent to the sale of the Bonds. The Board of <br />County Commissioners however agrees that if the Bonds are issued for the financing of a courthouse <br />addition that it will accept title to the property financed by the Bonds to be issued by the Cass County <br />Building Authority when those obligations are discharged. <br />Dated at Fargo, North Dakota this 20th day of March, 1985. <br />Mrs. Stanton moved and Mr. Eckert seconded that WDAY Radio be authorized to do a live broadcast <br />from the bell tower of the Courthouse on the date of May 22, 1985, subject to approval of their liability <br />insurance. Motion carried unanimously. <br />Scott Krueger stated that the County's maintenance personnel discovered some cracks in the <br />southeast corner of the Courthouse. Mrs. Stanton moved and Mr. Eckert seconded to authorize Architect <br />Iry Holman to evaluate the soil in this area of the building by retaining Midwest Testing Laboratory. <br />Motion carried unanimously. <br />Mrs. Stanton moved and Mr. Sondrall seconded that the site on the south side of the Courthouse be <br />surveyed to obtain a legal description of the property which will be leased to the Cass County Building <br />Authority for the proposed south addition to the Courthouse. On roll call vote, the motion carried <br />unanimously. <br />Discussion was held on paying County employees twice per month rather than on a monthly basis as <br />they are presently paid. Mrs. Stanton stated that the County Commission passed a motion in August of <br />1979 approving paying salaries of County employees twice per month beginning in 1980, but the motion was <br />never implemented. Mr. Wieland suggested that the Auditor ask the County Treasurer to determine how much <br />interest money the County would lose by paying employees twice per month, and to report back next week. <br />Mrs. Stanton moved and Mr. Eckert seconded that a letter be sent to North Dakota Governor George <br />Sinner asking him to veto Senate Bill No. 2296 which provides for a tax reduction for agriculturally <br />derived alcohol blended fuels. Motion carried unanimously. <br />Upon the recommendation of County Court Judge Donald Cooke, Mr. Eckert moved and Mr. Sondrall <br />seconded to sign a contract with Joanne Ottmer of Jamestown to act as Public Defender in conjunction with <br />Cass County mental health proceedings for the sum of $2,500.00 for the period of March 1, 1985 through <br />February 28, 1986.
