PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS OF CASS COUNTY, NORTH DAKOTA 6198 REGULAR MEETING OF CASS COUNTY COMMISSIONERS OCTOBER 16, 1984 Chairman Stanton called the meeting to order and upon roll call, all members were present. Mr. Larson moved and Mr. Eckert seconded that the minutes of the previous meeting be approved as written. Motion carried. Mr. Edwin Piper was present to report a bridge in Section 24, Maple River Township, which has trees and brush underneath it that need to be cleaned out before it damages the bridge. Mr. Eckert will discuss the matter with the County Road Superintendent. Mr. Sondrall moved and Mr. Larson seconded to approve the Application for a Raffle Permit for the NDSU Rodeo Club to be held on October 26, 27 and 28, 1984, at the Red River Valley Fairgrounds. On roll call vote, the motion carried unanimously. Mr. Terry Nelson from No-Dak Bonds reported on bids for Refunding Improvement Bonds for the Chrisan 2nd and Chrisan 3rd Subdivisions and the Riverdale Subdivision Street Improvement Districts. The low bid was from American National Bank in the amount of 9.3961% interest. Mr. Larson moved and Mr. Wieland seconded to adopt the RESOLUTION CREATING THE FUND OF AN IMPROVEMENT DISTRICT, PROVIDING FOR AN APPROPRIATING SPECIAL ASSESSMENT FOR THE SUPPORT AND MAINTENANCE OF SAID FUND, AND AUTHORIZING THE ISSUANCE OF IMPROVEMENT WARRANTS THEREON and to adopt the RESOLUTION DIRECTING THE ISSUANCE AND ESTABLISHING THE TERMS AND CONDITIONS OF $235,000 REFUNDING IMPROVEMENT BONDS. Clerk of Court County Court Register of Deeds Sheriff Veterans Service Office $ 5,740.25 $30,073.90 $ 9,933.00 $ 7,079.60 Mr. Eckert moved and Mr. Sondrall seconded_that Architects Clark, Holman and Moorhead be authorized to hire Midwest Testing Laboratory to conduct necessary soil testing for the proposed southside addition to the Courthouse. On roll call vote, the motion carried unanimously. Scott Krueger, Administrative Assistant, reported that there is a need for someone to administer the pay-back of the Community Development Block Grant Funds for the Kindred True Value Hardware, and to write an environmental impact statement: A letter was received from Blue Cross-Blue Shield asking if the County wishes to include Organ-Tissue Transplants on the group health insurance policy. There would be no significant increase on the renewal rate but useage of it could have a large effect. The Commission will make a determination in December prior to renewal of the health insurance contract for 1985. Mr. Bill Piper from SERVPRO OF FARGO-MOORHEAD presented an estimate of $753.58 for cleaning the carpet and drapes in the basement of the Cass County Annex, and he presented an estimate of $1,851.60 for carpet cleaning on all three floors of the Courthouse. The Commission will consider the proposal. Attorney Daniel Twichell was present regarding confirmation of the special assessment list for the South Acres Sewer and Water Improvement District. Also present were Robert Weeks, Mr. and Mrs. Archie Maier, Betty Pryzbilla and Douglas Seiler, all property owners within this Special Assessment District. Mr. Weeks presented a petition signed by 17 property owners requesting that all special assessments for the South Acres Water and Sewer project be re-evaluated and each property owner be assessed equal dollar amounts. Mr. Weeks stated that he is protesting the special assessments on one lot which were reduced for the reason that it was felt it would be too low to build upon. Attorney Twichell stated that this has been a very difficult project. He stated that the Special Assessment Commission viewed all of the lots and determined that the above mentioned lot, which does not have the potential for building upon, should be treated differently than the rest of the lots. He stated that there is no curb connecti on on thi slot, whi ch woul d have increased the assessment by about $1,000.00. Mr. Twichell stated that he devised a resolution which he read to the Commission and to the landowners. Mr. Weeks stated that he can accept this resolution. Mr. Larson moved and Mr. Wieland seconded to adopt the following Resolution: On roll call vote, the motion carried unanimously. WHEREAS, construction of a water and sewer project, hereinafter referred to as Cass County Water and Sewer District No.1 has been constructed in an area in Cass County known as South Acres; and WHEREAS, the assessment of the cost of the project has been completed; and WHEREAS, one of the vacant lots within the district was assessed in an amount less than other vacant lots in said district.
