<br />PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br /> <br />GI90 <br /> <br />REGULAR MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />SEPTEMBER 11, 1984 <br /> <br />Chairman Stanton called the meeting to order and upon roll call, all members were present. <br /> <br />Mr. Larson moved and Mr. Wieland seconded that the minutes of the previous meeting be approved <br />as written. Motion carried. <br /> <br />Mr. Larson moved and Mr. Eckert seconded that the Chairman be authorized to sign the document <br />from the State "Highway Department regarding the 1985 Construction Program. On roll call vote, the <br />motion carried unanimously. <br /> <br />Steve Grindberg, County Road Superintendent, received a letter from the North Dakota Highway <br />Patrol concerning Section 39-12-05 of the North Dakota Century Code, which grants permission to allow a <br />10% weight increase on trucks for movement of farm products from the field to place of storage at a fee of <br />$50.00 per vehicle. Upon the recommendation of Mr. Grindberg, Mr. Eckert moved and Mr. Larson <br />seconded not to g rant permission for a 10% weight exemption on trucks hauling on County roads due to <br />the condition of Cass County's roads. On roll call vote, the motion carried unanimously. <br /> <br />Steve Grindberg reported the results of the recent traffic counts taken on County Road 10, and <br />further discussion was held on the request of August 21, 1984, for re-shaping and re-surfacing County <br />Road 10 east of Mapleton. Chairman Stanton stated that it appears that a majority of the Commission, would <br />be in favor of re-shaping the road. Mr. G rindberg stated that the road does need to be re-built as there <br />is no drainage and no slopes. He did not feel the project could be done for 1985, but it could possibly be <br />worked into the 1986 program. The question of funds for this project will be discussed when the <br />Commission reviews the Road Department's budget on September 12, 1984. <br /> <br />Mr. Ken Pawluk presented petitions with approximately 155 signatures requesting improvements to <br />County Road 20 from the junction with County Road 17 to the junction with County Road 11. The County <br />considered improvements on this road a few years ago but ran into difficulties with over-head power lines <br />which would have to be removed at County expense, and obtaining necessary right-of-way. The <br />Commission will also consider this project during the Road Department's budget review. <br /> <br />A petition was received containing about 50 signatures requesting installation of railroad crossing <br />signal lights and cross arms on County Road 4 -between Sections 4-9, Amenia Township. Mr. Eckert moved <br />and Mr. Sondrall seconded to submit the petition to Steve Grindberg for evaluation and recommendation. <br />On roll call vote, the motion carried unanimously. <br /> <br />A protest hearing was held at 10; 00 A.M. on the Chrisan and Chrisan 2nd Subdivisions Street <br />Imrpovement District No. 1984-2. No written protests were filed, and no'verbal protests were made at the <br />hearing. <br /> <br />Mr. Eckert moved and Mr. Larson seconded that the County Auditor be authorized to sign the <br />Certificate of County Auditor stating that no property owners filed protests against the Chrisan and <br />Chrisan 2nd Subdivisions Street Improvement District No. 1984-2. On roll call vote, the motion carried <br />unanimously. <br /> <br />Mr. Larson moved and Mr. Sondrall seconded to adopt the RESOLUTION DETERMINING THAT NO <br />PROTESTS WERE FILED ON IMPROVEMENT IN STREET IMPROVEMENT DISTRICT NO. 1984-2 CHRISAN <br />AND CHRISAN 2nd SUBDIVISIONS. On roll call vote, the motion carried unanimously. <br /> <br />Mr. Eckert moved and Mr. Sondrall seconded to adopt the RESOLUTION ACCEPTING BID, SHOWING <br />RECEIPT OF ENGINEER'S STATEMENT OF ESTIMATED COST AND DIRECTING EXECUTION OF <br />CONTRACT FOR STREET IMPROVEMENT DISTRICT NO. 1984-2 FOR CHRISAN AND CHRISAN 2nd <br />SUBDIVISIONS. Before the call of the question on the motion, States Attorney Robert Hoy reminded the <br />Commission of the concerns over drain fields in the County ditch. Project Engineer Steve Dewald stated <br />that an "Agreement Relating to Drainage" has been signed by all of the landowners involved stating and <br />agreeing to bring the drainage from their respective property into compliance with applicable drainage <br />laws and regulations to the satisfaction of Cass County prior to commencement of construction of the <br />street improvement project. <br /> <br />Further discussion was held on the drainage matter. Robert Hoy expressed legal concerns about the <br />enforceability of this drainage agreement. Three of the landowners involved were present and confirmed <br />that they will comply with the signed agreement. A spokesman for the fourth party stated that they will <br />also comply. It was the consensus of the Commission to have faith in the people that live in the area to <br />comply with the drainage agreement, and to approve the street improvement project as planned. <br /> <br />At the call for the question on the above motion to adopt the RESOLUTION ACCEPTING BID, the <br />motion carried on roll call vote with all members voting "Aye". <br /> <br />A presentation was made by Mr. Jim Stenerson, Mr. Charles Bailly and Mr. Vince Lindstrom <br />requesting financial support from Cass County in the amount of $50,000.00 for the proposed <br />Heritage-Hjemkomst Center to be constructed in Moorhead, Minnesota, as a cooperative agreement for the <br />entire Red River Valley.
