<br />PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br /> <br />r~ .'" <br />!~) ..t <br /> <br />REGULAR MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />JUNE 26, 1984 <br /> <br />Chairman Stanton called the meeting to order and upon roll call, all members were present. <br /> <br />Mr. Larson moved and Mr. Wieland seconded that the minutes of the previous meeting be approved <br /><;IS written. Motion carried. <br /> <br />Steve Grindberg, County Road Superintendent, reported that the utility permit for the Northern <br />Improvement Company on County Road 31 and County Road 20 north of Fargo, which the Commission <br />approved at their last meeting, will be delayed until the County receives additional right of way as <br />agreed by the developer. <br /> <br />A letter was received from the North Dakota Highway Department regarding the 1985 construction <br />program. Cass County will receive Federal Aid Secondary Funds in the amount of $196,000.00, an <br />increase of $37,000.00 according to Mr. Grindberg. <br /> <br />Discussion was held on the bids received on June 19th for the furnishing of a new or used motor <br />grader for the County Road Department. Steve Grindberg stated that the bid of the Northwestern <br />Equipment Company contained a note stating that "For the offer of this bid to be accepted by Cass <br />County, the purchase option must be exercised by the County at the time of award. Purchase option <br />payment may be made at any'time during the 6 month rental period." The County had advertised for <br />bids on the basis of a six-month rental with option to buy at the end of six months. Robert Hoy, <br />States Attorney, stated that it appears that the bid of Northwestern Equipment, Inc. contains a <br />condition which the Commission may agree to by purchasing rather than renting a motor grader or the <br />Commission can reject the bid. <br /> <br />Mr. Eckert moved and Mr. Wieland seconded to reject the bid of Northwestern Equipment, Inc. for <br />a motor grader because of the condition that was attached to the bid. However, Bob Hoy stated that a <br />separate motion to reject the bid is not necessary because a motion accepting one of the other bids <br />would have the same effect. Mr. Eckert withd rew his motion and Mr. Wieland withd rew his second. <br /> <br />Upon the recommendation of Steve Grindberg, Mr. Eckert moved and Mr. Larson seconded to <br />accept the low bid of General Equipment. and-Supply, Inc. in the amount of $85,065.00 for a new motor <br />grader on a six-month rental wi th option to buy. On roll call vote, the motion carried unanimously. <br /> <br />Attorney Jon Arntson appeared to reque_st the Commission to create Street Improvement District <br />1984-1 in Riverdale Subdivision, locatea in Stanley Township between the cities of Horace and <br />West Fargo along County Road 17. He stated that there are 24 lots in the subdivision with 21 property <br />owners. Petitions to' create this special street improvement district have been signed by 18 property <br />owners. Only one property owner is opposed to the project. <br /> <br />Engineer Stevan Dewald, Lightowler and Johnson Associates, has prepared the plans and <br />specifications. He stated that the total estimated project cost is $60,150.00. A drainage problem in one <br />area of the subdivision has not been addressed in the project as they feel it will not be detrimental to <br />the roadway. However, Steve Grindberg stated that he would like to have an opportunity to investigate <br />the drainage problem mentioned by Mr. Dewald, and the Commission would like to have Mr. Grindberg's <br />opinion before approving the project. Mr. Arntson felt that this problem could be addressed and <br />resolved prior to final approval by the Commission. <br /> <br />The Board reviewed the list of guidelines which were 'adopted on August 23, 1983. Mr. Arntson <br />stated that he will be discussing with the States Attorney the requirement on the 30% special fund for <br />delinquencies because of a question by the Internal Revenue Service. The Commission also discussed <br />including in the guidelines that the County Road Superintendent approve the project plans. <br /> <br />Mr. Larson moved to approve the plans and specifications for the Riverdale Subdivision Street <br />Improvement District 1984-1. However, Mr. Arntson stated that' he has a series of resolutions which <br />need to be acted upon. Mr. Larson withdrew his motion. <br /> <br />Mr. Sondrall moved <lnd Mr. Larson seconded to adopt the following resolutions for the <br />establishment of Street Improvement District 1984-1 for Riverdale Subdivision; RESO LUT ION CREA T I NG <br />STREET IMPROVEMENT DISTRICT NO. 1984-1 OF THE COUNTY OF CASS, NORTH DAKOTA; <br />RESOLUTION DIRECTING ENGINEER TO PREPARE REPORT; RESOLUTION APPROVING ENGINEER'S <br />REPORT; RESOLUTION DIRECTING ENGINEER TO PREPARE PLANS AND SPECIFICATIONS; <br />RESOLUTION APPROVING PLANS AND SPECIFICATIONS; RESOLUTION DECLARING WORK NECESSARY; <br />and RESOLUTION DIRECTING AUDITOR TO ADVERTISE FOR BIDS. On roll call vote, the motion <br />carried unanimously. <br /> <br />Mr. Wieland, moved and Mr. Eckert seconded to include in the County's guidelines that plans and <br />specifications for the creation of special assessment districts be submitted to the County Road <br />Superintendent for consideration and approval. On roll call vote, the motion carried unanimously. <br /> <br />Regarding the Holmen's 2nd and Holmen's 3rd Subdivision paving projects, Engineer Stevan Dewald <br />presented a letter from F-M Asphalt, Inc. requesting an extension to August 1st on the completion <br />dates for the above projects due to recent rainfalls. Because of the nature of the projects, Mr. Dewald <br />recommended taking no action today but he wanted to make the Commission aware of the situation. <br /> <br /> <br />Utility permit for <br />Northern Improvemnt' <br />Co. to be delayed <br /> <br />St. Hwy.
