After further discussion, the motion was changed to delay any action <br />'I until the water recedes and Mr. Grindberg can make a final inspection of the condition <br />,of the bridges. The motion failed on roll call vote with only <br />Mrs. Stanton and Mr. Sondrall_voting "Aye"; Mr. Wieland, Mr. Eckert and Mr. Larson <br />voting "No". <br /> <br />Mr. Larson moved and Mr. Wieland seconded to appoint Steve Mottinger as one of the <br />Public Defenders for Cass County for a contract periOd from July 1, 1983 through <br />December 31, 1983, for the sum of $6,250.00 for the-contract period. On roll call vote, <br />the motion carried unanimously. <br /> <br />Mr. Larson moved and Mr. Wieland seconded to appoint William Kirschner as one of <br />the Public Defenders for Cass County for a contract periOd from July 1, 1983 through <br />December 31, 1983, for the sum of $6,250.00 for the contract period. The motion:'earried <br />on roll call vote with four members voting "Aye" and Mr. Sondrall opposing. <br /> <br />Upon the request of Sheriff Don Rudnick, Mr. Larson moved and Mrs. Stanton seconded <br />to approve the Jail Policy Manual for the operation of the jail as prepared by the <br />Sheriff's Department in accordance with State rules and regulations. On roll call vote, <br />the motion carried unanimously. <br /> <br />Sheriff Don Rudnick discussed five areas of corrective action taken by the <br />Sheriff's Department following the March 23, 1983, jail inspection by the office of the <br />North Dakota Attorney General. One area where corrective measures have not been taken <br />as yet is the heat situation in the jail when the temperature outside is hot. The <br />Attorney General's Office has been receiving letters from prisoners in the County Jail <br />complaining about the temperature. The maximum allowed temperature is 85 degrees, <br />and Sheriff Rudnick stated that some areas of the jail have exceeded that when it is <br />very hot outside. The Commission felt that a solution to the problem may be to install <br />wall unit air conditioners on each floor in the lobby areas, and Mr. Sondrall was asked <br />to obtain cost estimates and an idea of how many units would be needed. <br /> <br />Mrs. Stanton moved and Mr. Larson seconded that a letter be sent by the Commission <br />to the North Dakota Attorney General reporting the completion of the five areas where <br />correction was needed in the Cass County Jail, and that a letter be written to the <br />Attorney General requesting a 30-day variance on their regulations concerning the maximum <br />temper.ature within the jail to allow the Commission time to correct the situation. <br />On roll call vote, the motion carried unanimously. <br /> <br />A Special Assessment Hear.ing was held on the Forest River area paving project, <br />and no one appeared to protest the assessments. Mr. Larson moved and Mr. Wieland <br />seconded that the Chairman be authorized to sign the following Resolution Confirming <br />Assessment List of Chrisan, Chrisan Glenn and Fores~ River Subdivisions Special Improvement <br />District No.1: On roll call vote, the motion carried unanimously. <br />
