Mr. Grindberg stated that the <br />Iproposed bid letting date is in November and construction would not begin until 1984 <br />ISO the County's share of $50,000.00 could be included in the 1984 Highway Department budget. <br />IAt the call for the question, the motion carried on roll call vote with all members <br />i voting "Aye". <br />I <br /> <br />Duplicate copies Mr. Grindberg stated that the State Highway Department bid letting for the bridge <br />signed for Maint. 12.5 miles north of Horace on County Road 17 has been changed from May to June 17, 1983. <br />& R/W Agreements IMrs. Stanton moved and Mr. Larson seconded that the Chairman be authorized to sign <br />for bridge on iduplicate copies of the Maintenance and Right of Way agreements for the above project. <br />C17 near Horace ion roll call vote, the motion carried unanimously. <br />I <br /> <br />Frontier drainagel Regarding the drainage problem in the City of Frontier, it was reported to the <br />problem disc. ,Commission that an engineering qonsultant is studying the situation and will make a <br />Irecommendation to the Sougheast Cass Water Resource Board. The road to Frontier is <br />jdesignated on the map as County Road 6, but Mr. Grindberg stated that it is not included <br />ion the County Road System. He stated that there is a written agreement whereby the <br />iState Highway Department paved the road and the County maintains it. The Commission <br />',reqUested the States Attorney to investigate the procedure for turning over a road <br />to another governmental entity. <br />I <br /> <br />Disc. on Public i Attorney Mark Beauchene appeared before the Board representing the Kraemer, Beauchene <br />Defender Contract 'I and Associates Law Firm, which is doing about 95% of the court cases in Cass County <br />with Kraemer Law ,involving indigent persons under the Public Defender System. He stated that under the <br />Firm--Bd. auth. ! same contract and in regard to the mental health cases, his firm has been representing <br />them to bill I' indigent persons who are not residents of Cass County but their court appearance is held <br />other counties ,in this County. <br />for services to I <br />residents of According to North Dakota State Statute, counties may bill another county for <br />their County services to indigent persons who are residents of that county. Reimbursement has not been <br />I sought for such services in the past, but Mr. Beauchene stated that the Cass County Court <br />I presently has about $600.00 in bills for services rendered to persons who are residents <br />of other counties. He requested the Commission to seek reimbursement for these bills <br />I to be paid to the County general fund, and that his firm be paid by Cass County. <br /> <br />I Mr. Larson moved to authorize the Public Defender firm to bill other counties for <br />I indigent counsel and to bill up to $600.00 for services _previously rendered to <br />indigent persons who are not residents of Cass County, effective thorugh July 15, 1983, <br />II at which time the present Public Defender Contract will expire; the payment to be made <br />directly to Cass County. Mrs. Stanton seconded the motion for discussion, and <br />IMr. Beauchene stated that he would not like to be limited to the $600.00. He stated <br />I that he would be prepared to examine the cases as far back as when they first took over <br />i the public defender contract and submit bills on all of the cases where services were <br />I'rendered to individuals who are residents of another county. He stated that he could <br />,provide a list of the cases to the Commission that are to be billed to other counties. <br /> <br />I Mrs. Stanton amended the motion to withdraw the $600.00 limitation. The amended <br />I motion was seconded by Mr. Wieland and carried on roll call vote with all members <br />II voting "Aye". Upon roll call vote, the first motion as amended was carried with all <br />members voting "Aye". <br /> <br />I Discussion was again held on new legislation enabling counties and cities to grant <br />i a two-year general tax exemption on new residential construction beginning after <br />! March 31, 1983, with properties being eligible for the exemption if completed before <br />IJanUary.l,1985. <br /> <br />. Bob Hoy, States Attorney, did some checking on the Board's discussion from <br />I last week of making possible restrictions rather than granting the exemption to all <br />'I properties. He stated that the North Dakota Tax Department officials feel that there <br />could be no restrictions placed upon granting the exemptions. Mr. Hoy stated that he <br />would feel most comfortable with adopting it in full or not at all. Mrs. Stanton <br />i moved and Mr. Larson seconded to postpone any action on this matter until the County <br />i receives some regulations from the State Tax Department and have an opportunity <br />i to study them.
