Rail. law.! <br />Dance permit <br />granted to Ronda <br />Borgerson <br /> <br />The Auditor received a call asking if Cass County would be willing to meet with <br />i the Richlimd County Board of Commissioners to discuss the possibility of sharing <br />i a County Superintendent of Schools. Mrs. Wold suggested meeting with them after <br />i the States Attorney has a chance to search the law on what options the County has <br />! regarding the office of Superintendent of Schools. The Chairman requested Mrs. Wold <br />i to write a letter to Joe Crawford, the State Superintendent of Public Instruction, <br />j to get his ideas on the matter. <br />I <br /> <br />On motion by Mr. Larson and seconded by Mrs. Stanton, the meeting was adjourned. <br /> <br />REGULAR MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />AUGUST 19, 1981 <br /> <br />Chairman Hendrickson called the meeting to order and all members were present. <br /> <br />Mrs. Stanton moved and Mr. Eckert seconded that the minutes of the previous meeting <br />be approved as written. Motion carried. <br /> <br />Attorney Dick Peterson appeared before the Board and presented a blueprint of the <br />proposed Special Improvement District No. 1 for asphalt paving in the subdivisions of <br />Forest River, Forest River Second, Chrisan, Chrisan Second and a portion of Chrisan Glen. <br /> <br />Mrs. Stanton moved and Mrs. Wold seconded that the Chairman be authorized to sign the <br />resolution retaining the engineering firm of Koehnlein, Lightowler and Johnson to prepare <br />the plans and specifications, and the law firm of Peterson & Sasseville to provide legal <br />services in connection with the creation of the special assessment district. Said Project <br />shall be at no financial obligation to Cass County; and the affected landowners shall pay <br />all expenses incurred ,in the preparations such as the engineering and legal fees and the <br />cost of necessary'publications even if the project fails. On roll call vote, the motion <br />carried unanimously. <br /> <br />Marvin Witt, Executive Director of the Red River Valley Fair Association, appeared <br />before the Board with a request to transfer their beer license to the Shanley Parent <br />Council for the date of September 18, 1981, during an auction to be held at the <br />fairgrounds. The matter was referred to Robert Hoy, Assistant States Attorney, who <br />reported to the Board that it would not be legal for the Red River Valley Fair Board <br />to authorize another agency to use their beer license. The Board requested that Mr. Witt <br />be advised that their beer license cannot be transferred to any other organization. <br /> <br />Upon the recommendation of the County Director of Tax Equalization, Mr. Eckert <br />moved and Mr. Larson seconded that the Application for Abatement and Settlement of Taxes <br />submitted by Nils Wallace Erickson be denied for the reason that the assessment is not <br />inequitable or unjust when compared to other like property in the area. On roll call vote, <br />the motion carried unanimously. <br /> <br />Upon the recommendation of the,County Director of Tax Equalization, Mrs. Wold moved <br />and Mrs. Stanton seconded that the Application for Abatement and Settlement of Taxes <br />submitted by Centre, Inc. be denied in accordance with the recommendations stated by <br />Clarence Miller at the County Commission meeting held on April 7, 1981, which recommenda- <br />tion was supported in a recent opinion from the North Dakota Attorney General's Office. <br />On roll call vote, the motion carried unanimously. Attorney Alice Olson, President of <br />Centre, Inc. was present and stated that she feels the matter may be taken to Court for <br />clarification of the law because she stated that Centre does not pay any rent and no <br />money is being made off the property. She stated that the property is wholly used for <br />a charitable purpose by its owner and that it is wholly used for a charitable purpose by <br />its occupant. <br /> <br />Upon the recommendation of the County Director of Tax Equalization, Mrs. Stanton <br />moved and Mrs. Wold seconded that the Application for Abatement and Settlement of Taxes <br />submitted by B M & H, a partnership, be denied for the reason that the assessment is <br />equitable and uniform with other comparable property in the City of Fargo. On roll-call <br />vote, the motion carried unanimously. <br /> <br />Mr. Eckert, Vice Chairman of the newly appointed County Weed Control Board, stated <br />that the Board of County Commissioners may set rates of compensation for Weed Control <br />Board members. However, the Commissioners felt that there are various other boards <br />throughout the County who do not receive compensation for attending meetings. <br />Mr. Eckert moved and Mr. Larson seconded that the members of the County Weed Control <br />Board receive reimbursement for actual and necessary expenses and a mileage allowance <br />at the rate established by State law. On roll call vote, the motion carried unanimously. <br /> <br />Mrs. Wold moved and Mr. Eckert seconded that the Chairman be authorized to sign the <br />resolution authorizing Cynthia Rothe, States Attorney, to request the North Dakota <br />Attorney General's Office to represent Cass County in the Burlington Northern Railroad <br />lawsuit on their 1980 property taxes. On roll call vote, the motion carried unanimously. <br /> <br />Mr. Eckert moved and Mr. Larson seconded that a dance permit be granted to Ronda <br />Borgerson to hold a wedding dance at the Red River Valley Fairgrounds on the date of <br />October 10, 1981. The motion carried on roll call vote with only Mrs. Stanton opposing <br />because she felt the Board should have information on whether liquor will be sold at <br />such.'an event. <br />
