States Attorney Cynthia Rothe stated that the County would <br />'have no authority in this matter. <br /> <br />Mrs. Wold moved and Mr. Hendrickson seconded that the County purchase one car <br />from Selland Motors and Company and two cars from Corwin Chrysler-Plymouth, Inc. <br />with the additions as recommended by the Sheriff's Department. On roll call vote, <br />the motion carried unanimously. <br /> <br />Mr. Hendrickson moved and Mrs. Wold seconded that the A-95 Review from the <br />Metropolitan Council of Governments for a grant to the Southeastern North Dakota Community <br />;Action Agency for solar commercialization be given an "Unfavorable Review',' because the Board <br />feels it is not needed. On roll call vote, the motion carried unanimously~ <br /> <br />On motion by Mrs. Wold and seconded by Mr. Hendrickson, the meeting was adjourned. <br /> <br />ADJOURNED MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />JULY 30, 1980 <br /> <br />Chairman Stanton called the meeting to order and upon roll call, all members <br />were present. <br /> <br />Mrs. Wold moved and Mr. Hendrickson seconded that the minutes of the previous meeting <br />be approved as written. Motion carried. <br /> <br />Reed Twp. delega- <br />!tion expressed <br />'concern over <br />~est Fargo Airport <br />;construction <br />I <br />!Bids awarded <br />~or cars for Shff. <br />Dept. <br /> <br />iA-95 Review for <br />~AA solar commer- <br />~ialization given <br />i"Unfavorable Rev': <br /> <br />Regarding the bridge which was burned between Sections 35-36, Barnes Township, Disc. on bridge <br />the County Road Superintendent stated that it would cost approximately $5,000.00 !replacement in <br />to repair the bridge for only cars to travel across. He felt that the bridge could be $arnes Twp.-- <br />eliminated since County Road 6 is one-half mile away. Petitions were received last Wednesday Petitions reed. <br />containing 150 signatures requesting that the bridge be repaired, and petitions were presented with addtl. <br />this morning with 50 additional signqtures. Mr. Grindberg asked the Board to drive out i signatures <br />and look at it with him, and the matter will be discussed again next Wednesday. <br /> <br />Discussion was held with Ed Murhpy and Bruce Britton regarding the contracts for <br />conflict of interest attorneys under the public defender system, and they questioned <br />the section which requires them to have malpractice insurance. Mr. Murphy stated that <br />the County Auditor informed him that the County's policy does not cover malpractice <br />insurance for the States Attorney and her staff. The States Attorney was present and <br />stated that she understands that the County would also be named in a law suit but the <br />intent of including this requirement in the contract was that the County alone would not <br />be liable if the attorney had malpractice insurance. She also stated that the County's <br />general liability policy covers herself and her employees. She stated that when a <br />part-time assistant works in the capacity as an Assistant States Attorney, then that person <br />would be covered under the County's liability policy. <br /> <br />Mr. Murphy stated that a malpractice insurance policy with $1,000 deductible <br />would cost about $300 annually, and he, felt that the County should pay for the insurance <br />for each of the conflict attorneys. He stated that he would be willing to sign the <br />contract today with the understanding that the issue on the malpractice insurance <br />be placed in abeyance until it is resolved. Mr. Britton stated that he would also sign <br />his contract today, and that he would be willing to contact Fred Kraemer, who received <br />the bid for Public Defender, to ask him what percentage he feels the County is paying <br />on his malpractice insurance. Mr. Hendrickson moved and Mrs. Wold seconded that the <br />Chairman be authorized to sign the contracts with Ed Murphy and Bruce Britton for <br />conflict attorneys. On roll call vote, the motion carried unanimously. <br /> <br />, <br />i <br />:Disc. on malprac- <br />;tice insurance <br />~or Conflict Attys <br /> <br />Contracts signed <br /> <br />i <br /> <br />A sales representative from Corwin-Chrysler Plymouth was present and stated that ~o. to pay addtl. <br />his firm neglected to include the price of air conditioning on the 1980 Volare 'for cost of air <br />station wagon on which the County accepted their bid last Wednesday for cars for the conditioning on <br />Sheriff's Department. He requested the Commission to consider their mistake, as he felt they~ar from Corwin- <br />would still be below the next lowest bid. Mrs. Wold moved and Mr. Hendrickson seconded that Chrysler Plymouth <br />the County pay the factory-installed price for air conditioning in the amount of $541.00 <br />on this vehicle. On roll call vote, the motion carried with Mr. S'atrom opposing. <br /> <br />Mrs. Wold moved and Mr. Hendrickson seconded that the letter from the Fargo Youth <br />Commission/Depot Youth Center requesting the Board to reconsider their budget request <br />for 1980-1981 in order to continue their program be received, filed and discussed further <br />next week with the County Auditor.
